A RESOLUTION AUTHORIZING A TWELVE MONTH LEASE WITH FIVE AUTOMATIC
ONE YEAR EXTENSIONS OF AN APARTMENT IN THE APARTMENT BUILDING
COMPLEX LOCATED ON LOT 5A, U.S. SURVEY 2538A TO THE KODIAK AREA
NATIVE ASSOCIATION (KANA)
WHEREAS, the Kodiak Island Borough received restricted title to the apartment
building complex located on Lot 5A, U.S. Survey 2538A from the State
of Alaska on February 8, 1980; and
WHEREAS, the restrictive nature of this deed limits the use of this property for
school or other public purposes only, as well as making the above
property available to Indians and Non -Indians on the same terms; and
WHEREAS, Title 18.401.020(B) of the Kodiak Island Borough Code of Ordinances
provides for leases with non-profit corporations at reasonable rental
rates, taking into consideration the purpose for which the real property
is to be used; and
WHEREAS, the Kodiak Area Native Association (KANA) has leased these facilities for
many years with the current lease of the facilities expiring on June 30
of every year; and
WHEREAS, KANA has requested a twelve month lease until June 30, 1992; and
WHEREAS, KANA qualifies as a non-profit organization and utilizes the facilities to
benefit children and adults from around the Borough.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The Kodiak Island Borough Assembly approves a twelve month lease of
apartment G to KANA (same as KTC).

Section 2: Consecutive one year extensions be continued until terms or conditions
of the lease change.
Section 3: The Borough staff is authorized to enter into the lease agreement with
KANA.
