RESOLUTION NO. 91-30
A RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTY BY
NEGOTIATED PURCHASE FOR ELEMENTARY SCHOOL CONSTRUCTION
PURPOSES AND SETTING TERMS AND CONDITIONS
WHEREAS, existing school facilities are close to design capacity in terms of the
maximum numbers of students the facilities can accommodate; and
WHEREAS, population projections of young children scheduled to enter elementary
school demonstrate a need for a new school facility; and
WHEREAS, planning for a new school is a multi-year process requiring lead time for
site acquisition, design and construction of a new facility; and
WHEREAS, a proposed ten acre school site has been identified for acquisition on
Otmeloi Way; and
WHEREAS, negotiations have resulted in an agreement to purchase a parcel of real
property consisting of 1.3 acres at a price of $42,500;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH:
Section 1. In accordance with KIB Code Section 18.10.020, the Mayor is
authorized to enter into an agreement to purchase the following lot for
$42,500 with a down payment of $7,500 and pay closing costs
associated with the sale.
Lot 7, Block 9, Miller Point Subdivision, First Addition
Section 2. The present landowner is permitted to extract gravel from the site for the
remainder of the year and for one additional year subject to the site
development plan prepared for the school site, posting of a bond, proof
of insurance, and conformity with all other requirements of the Borough
Code.

Section 3. The borough will set up an account payable to make monthly
installments of $743.65 per month at 10% annual interest for five years
commencing on February 1, 1992.
Section 4. The Borough Mayor or his designee is authorized to sign all necessary
paperwork to affect said purchase.
