RESOLUTION NO. 91-25
A RESOLUTION AUTHORIZING THE ACQUISITION OF A PORTION OF LOT 7,
U.S. SURVEY 3101 FOR ROAD CONSTRUCTION PURPOSES
WHEREAS, the Kodiak Island Borough has identified the construction of Sharatin Road
in its capital improvement program; and
WHEREAS, the road has been engineered and will be put out for bid in the summer of
1991; and
WHEREAS, to contain the project's fill slopes and to meet requirement for proper curve
orientation, a 1,224 square foot acquisition of Lot 7, U.S. Survey 3101 must
be acquired; and
WHEREAS, Kodiak Island Borough Code Section 18.10.020 requires Assembly
resolution spelling terms and conditions of land acquisitions; and
WHEREAS, Borough staff has entered into negotiations with the landowner for the
acquisition of private property based on fair market value;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH:
Section 1. The Assembly authorizes the negotiated purchase of an easement
containing a 1,223 square foot portion of Lot 7, U.S. Survey 3101 for road
and utility purposes in an amount not to exceed $1,650.
Section 2. The Kodiak Island Borough will pay the closing costs associated with this
transaction.
Section 3. The Borough Mayor or his designee may finalize the negotiated purchase
of an easement on the above lot and sign all paperwork to affect said sale.
