1991-03 Supporting the Transfer of Peterson Elementary School from the United States Government.Introduced by: Mayor Selby Recommended by: KIB School Board Drafted by: Engineering & Facilities Director Date: 02/07/91 Adopted: 02/07/91 KODIAK ISLAND BOROUGH RESOLUTION NO. 91-03 A RESOLUTION SUPPORTING THE TRANSFER OF PETERSON ELEMENTARY SCHOOL FROM THE UNITED STATES GOVERNMENT WHEREAS, the federal government would like to convey ownership of Peterson Elementary School to the Kodiak Island Borough; and WHEREAS, Peterson Elementary School does not currently meet the Kodiak Island Borough's codes and facility requirements; and WHEREAS, to accept Peterson Elementary School in its existing condition the Kodiak Island Borough would be assuming the liability of the current deficiencies; and WHEREAS, representatives of the federal government, State of Alaska Department of Education and Department of Health and Human Services, representatives of the Kodiak Island Borough and the Kodiak Island Borough School District have identified the specific deficiencies that need to be corrected; and WHEREAS, the cost of correcting the identified deficiencies is approximately $3,000,000; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH: Section 1. The Kodiak Island Borough will accept title to Peterson Elementary School if the federal government provides funds to correct the identified deficiencies, conducts a site assessment, assumes responsibility for correcting any environmental deficiencies prior to title transfer. Section 2. The United States Department of Education holds the Kodiak Island Borough, its agents, officers, and employees harmless and indemnifies them against and from any and all claims, demands, losses, costs, damages, suits, judgements, penalties, expenses, and liabilities of any kind or nature whatsoever arising Kodiak Island Borough, Alaska Resolution No. 91-03 Page 1 of 2 directly or indirectly out of or in connection with the discharge of oil or any other hazardous substance within the facilities or in connection with the violation of any state or federal statutes or regulations relating to environmental pollution or hazardous substance release occurring on or before the date of transfer.
