RESOLUTION NO. 90-02
A RESOLUTION RECOMMENDING ADOPTION OF SENATE BILL 229,
AN ACT RELATING TO GOVERNMENT LIABILITY FOR DAMAGE OR INJURY
RESULTING FROM HAZARDOUS RECREATIONAL ACTIVITIES
WHEREAS, the Kodiak Island Borough urges the State to
exercise its responsibility to provide a full range of recreation
opportunities for all Alaskans; and
WHEREAS, certain standard recreational activities have
an inherent risk of injury which under current state statutes limit
the Kodiak Island Borough in its ability to provide recreational
opportunities to its citizens; and
WHEREAS, municipalities are having to reduce or close
recreational services because liability insurance is either
unavailable or too expensive; and
WHEREAS, voluntary organizations help provide the Kodiak
Island Borough with a broad spectrum of recreational activities not
being offered by the public sector and establishing a cooperative
relationship with the Kodiak Island Borough would enable them to
provide programs they might not otherwise be able to provide; and
WHEREAS, the President's Commission on Americans Outdoor
has recommended that the standard of care for which an organization
or government should be responsible in providing recreational
opportunity be shifted from "mere negligence" to "gross
negligence;"
NOW, THEREFORE, BE IT RESOLVED, that the Kodiak Island
Borough Assembly, urges the Alaska State Legislature to adopt
