A RESOLUTION ESTABLISHING PROCEDURES FOR AN APPEAL
BY FELTON CONSTRUCTION
WHEREAS, the Kodiak Island Borough and Felton Construction
entered a contract for hospital site deveropment on November 23, 1987, and
WHEREAS, Felton Construction has filed an additional work claim,
and
WHEREAS, the contract provides for review of such claims by the
assembly but does not provide the procedure;
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough
Assembly that the following procedures are established for the purpose of
hearing an appeal by Felton Construction:
1. The appeal hearing shall be held on January 19, 1989, at the
regular meeting of the Kodiak Island Borough Assembly.
2. Felton Construction Company may submit oral argument in
support of its appeal limited to ten minutes; Borough staff or counsel may
submit oral argument supporting the decision of the contracting officer
limited to ten minutes; and the appellant may submit a reply argument limited
to five minutes.
3. The assembly will decide the appeal upon the appeal record
and the written and oral arguments presented.
