1988-27 Opposing the Passage of House Bill (HB) 522 and Senate Bill (SB) 445 Acts Relating to Municipal Planning Commissions.' A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY OPPOSING
THE PASSAGE OF HOUSE BILL 522 AND SENATE BILL 445;
ACTS RELATING TO MUNICIPAL PLANNING COMMISSIONS
WHEREAS, the Kodiak Island Borough Planning Commission
has statutory powers and duties under Alaska Statute Title 29 and
these duties are codified in Kodiak Island Borough Code Title 17; and
WHEREAS, planning commissions regularly function as quasi
judicial bodies when fulfilling their duties; and
WHEREAS, planning commissions should be perceived and act
as an impartial group of professionals and direct elections could
seriously damage this perception and hamper non - biased decision
making; and
WHEREAS, electing members to the planning commission would
alter the existing relationship of the commission with elected assembly
members of the borough; and
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island
Borough Assembly hereby opposes passage of House Bill 522 and Senate
Bill 445 because both bills are inappropriate and could seriously damage
the perception of planning commission decision making and hamper the
operation of planning commissions.
BE IT FURTHER RESOLVED that copies of this resolution be
sent to Governor Steve Cowper, Senator Fred Zharoff, Senator Ken
Fanning, Representative Cliff Davidson, Representative Mike Miller, and
Representative Steve Frank.
