1988-19 Authorizing the Acquisition of Interest in Certain Land in Port Lions for a Waterline Serving the Port Lions School.A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING THE
ACQUISITION OF INTEREST IN CERTAIN LAND IN PORT LIONS FOR A WATERLINE SERVING
THE PORT LIONS SCHOOL.
WHEREAS, KIBC Section 18.10.010(c) authorizes the acquisition of an
interest in real property; and
WHEREAS, KIBC 18.10.020 establishes a procedure of acquiring an interest
in real property by adoption of an Assembly resolution that may set terms,
conditions, and manner of acquisition; and
WHEREAS, the reconstruction of the Port Lions School requires a 6"
waterlain to better serve the schools water supply needs and fire protection
needs; and
WHEREAS, due to topographic constraints and location of the waterline
an easement across private property is required.
NOW, THEREFORE, BE IT RESOLVED that the Assembly authorized the Mayor to
enter into negotiations to acquire a utility easement across private land
legally described as Lot 5, Block 14, Port Lions Alaska Subdivision, to serve
the water needs of the Port Lions School.
PASSED AND APPROVED this 17 day of March , 1988 by the Kodiak
Island Borough Assembly.
