1988-17 Authorizing the Disposal of Certain Borough Land Associated with the Terror Lake Hydroelectric Project for Less than Fair Market Value to the State of Alaska.WHEREAS, KIBC Section 18.20.030(3) requires Assembly review and
authorization by resolution of the disposal of land found surplus to the
Borough's needs; and
WHEREAS, KIBC 18.20.100(8) states that the Assembly may dispose of land
for less than fair market value to the State of Alaska upon a finding of the
Assembly that the disposal will allow the use of the land for a public purFose
beneficial to the Borough; and
WHEREAS, survey of the project indicates that the location of the
powerhouse straddles the common ownership boundary shared by the State of
Alaska and the Borough; and
WHEREAS the Planning and Zoning Commission upon review of the project
survey and subdivision recommends that the encroachment of the powerhouse over
property lines be resolved prior to the filing of the survey; and
WHEREAS, the Alaska Power Authority is requesting the disposal of 12.5
acres of Borough owned land for less than fair market value offering "in the
range of $3,000.00 to cover any Borough administrative costs associated with

NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
authorizes the disposal of 12.5 acres of Borough land for less than fair
market value to the State of Alaska based upon the public benefit derived from
the Terror Lake Hydroelectric Project.
