1988-14 Authorizing a Twenty-Five Year Lease of Certain Borough Land Along Pillar Creek for Construction of a Salmon Hatchery.KODIAK ISLAND BOROUGH RESOLUTION NO. 88 -14 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING A 25 YEAR LEASE OF CERTAIN BOROUGH LAND ALONG PILLAR CREEK FOR CONSTRUCTION OF A SALMON HATCHERY. WHEREAS, KIBC Section 18.20.030 requires Assembly approval by resolution of all land disposals not subject to Assembly approval by ordinance, and subsequent to review by the Planning Commission; and WHEREAS, KIBC Section 18.40.020 authorizes the lease of Borough land to non - profit corporations at a reasonable rate taking into consideration the purpose for which the real property is to be used; and WHEREAS, the Borough has received a request to lease a minimum of five (5) acres of Borough land for a period of twenty -five (25) years from the State of Alaska Department of Fish and Game Division of Fisheries Rehabilitation, Enhancement and Development for a sockeye salmon hatchery; and WHEREAS, success of this venture will stimulate the local economy, boosting the commercial fishing, sport fishing, and tourism industries, and increase and expand high school and college fisheries curriculums, providing valuable training and experience to local students. NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough Assembly authorized the Mayor to enter into negotiations with the Alaska Department of Fish s Game, Fred Division for the lease of a minimum of 5 acres of Borough land legally described as Tract C, of BLM Tract D for a period of twenty -five (25) years and at a rental rate of one dollar (51.00) per year. BE IT FURTHER RESOLVED that the issuance of the lease be based on the following conditions: 1. It is the responsibility of the lessee to provide a plat of the site. This survey will show existing roads, powerlines, waterlines, watercourses, and waterbodiss. 2. The lessee will comply with all laws and regulations and acquire all necessary permits prior to development of the site. 3. This lease will terminate if construction has not commenced by January 1, 1992. III returned ; II ATTES 4. Upon termination of the lease, the area will be reseeded and to a natural state.
