1988-13 Authorizing the Execution of a Cooperative Participation Agreement Among Alaska Municipalities and School Districts Creating the Alaska Municipal League Joint Insurance Arrangement.the members of the Association. KODIAK ISLAND BOROUGH RESOLUTION NO. 88 -13 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY TO AUTHORIZE THE EXECUTION OF A COOPERATIVE PARTICIPATION AGREEMENT AMONG ALASKA MUNICIPALITIES AND SCHOOL DISTRICTS CREATING THE ALASKA MUNICIPAL LEAGUE JOINT INSURANCE ARRANGEMENT. WHEREAS, Alaska Local governments and school districts have generally been unable to procure adequate insurance coverage at reasonable prices; and WHEREAS, AS 21.76 enacted by the 1986 Alaska Legislature provides a means for local governments and school districts to join together in a joint insurance arrangement intended to mitigate the cyclical and erratic nature of the conventional insurance market; and WHEREAS, a not - for - profit Association is being established pursuant to AS 21.76 by the Alaska Municipal League to provide risk management services for Alaska municipalities, city and borough school districts and regional education attendance areas; and WHEREAS, this Association will provide pooling of risks, self - insurance management, joint purchase of insurance, claims administration, i loss prevention and control, insurance defense and other related risk management services on behalf of its members; and • WHEREAS, similar local government associations throughout the United States have been able to assure insurance coverages while obtaining significant long term economic savings for their members due to the joint buying power of the members, the non - profit tax- exempt status of the Association, the pooling and investment of premiums paid, and risk management services provided for members; and WHEREAS, AS 21.76.010 provides that two or more local governmental entities may enter into cooperative agreements for these purposes; and WHEREAS. it is now _ aaaaa for ten-i - - me `trs of iG Association to express a formal commitment to become a member of the Joint Insurance Arrangement and to make sufficient appropriations for annual premiums and assessments for a three year term or until all payment obligations have been satisfied as provided in a cooperative agreement among as follows: NOW THEREFORE, BE IT RESOL'IED, by the Kodiak Island Borough :ssertly Section 1. The Kodiak Island Borcugh Assembly hereby Ltdacaces its commitment to become a member of the Alaska Huticipal League Joint :rs•urance Association, organized pursuant to AS 21.76. 2y raking this commitment the Borough. Assembly hereby accepts and approves the bylaws cf the Association, a copy of which is attached hereto and incorporated by reference. Section 2. The Kodiak Island Borough Assembly hereby approves a Cooperative Participation Agreement (hereinafter the "Agreement ") among municipalities, school districts and regional educational attendance areas creating the Alaska Municipal League Joint Insurance Association, a copy of which is attached hereto and incorporated by reference. The Mayor is hereby authorized and directed to execute said "Agreement" and such other documents as may be necessary to effectuate participation of the Borough as a member of the Joint Insurance Association. ' Section 3. The Kodiak Island Borough Assembly pledges to appropriate sufficient funds for annual premiums and assessments to enable the "Agreement" to go into effect on July 1, 1988 and to remain in effect for a term of at least three years or until all payment obligations have been satisfied. Amounts payable to the Association, as encumbered by the "Agreement ", shall be classified as "operating expenses" and are subject to annual appropriation by the Borough Assembly. Section 4. The Kodiak Island Borough hods two options to withdraw from the program as follows: (1) Thirty days from receipt of the preliminary quotes. (2) Fifteen days from receipt of final quotes. Quotes should be received by June 1st. PASSED AND APPROVED THIS 17 day of March ,1988 by the Kodiak Island Borough Assembly.
