RESOLUTION NO. 66 - -
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REGARDING
PROPERTY TAXES UNDER THE ALASKA NATIVE CLAIMS SETTLEMENT ACT.
WHEREAS. the U.S. Congress may amend the Alaska Native Claims
Settlement Act, and
WHEREAS. the proposed amendments to said Act, if postponed or
revised, may deny local governments the authority to levy property taxes on
certain lands owned by Native Americans, and
WHEREAS, the Kodiak island Borough currently taxes undeveloped land,
and
WHEREAS, the Alaska Native Claims Settlement Act and the proposed
amendments to not clearly define undeveloped land. and
WHEREAS, there is an increasing possibility of various limits being
placed on the ability of local governments to tax.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
that:
1. The Kodiak Island Borough urges the U.S. Congress to clearly
define undeveloped and developed land. and
2. The Kodiak Island Borough encourages the U.S. Congress to
refrain from enacting amendments to the Alaska Native Claims Settlement Act
which will limit or eliminate the ability of local governments to tax
undeveloped Alaska Native Claims Settlement Act lands lying within the
boundaries of said local governments unless such amendments require the U.S.
D meet to pay to Alaskan local governments through the payment in lieu of
tax program an amount of money equal to the amount of property tax revenue
which would be levied undeveloped Alaska Native Claims Settlement Act land
lying within the boundaries of the local government.
