RESOLUTION NO. 86 -69 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY DECLARING CERTAIN
BOROUGH LAND SURPLUS FOR MUNICIPAL PURPOSES AND AUTHORIZING THE EXCHANGE OF
BOROUGH PROPERTY FOR PRIVATELY OWNED LAND.
WHEREAS, the Borough has entered into negotiations to acquire
private property to be reserved for public use; and
WHEREAS, the Borough is offering in exchange a tract of
industrial -zoned public land in the vicinity of the dry dump lease; and
WHEREAS, the exchange of these parcels will resolve long - standing
it legal disputes arising from private property rights and public interest; and
WHEREAS, the exchange of property will ensure the viability of an
I, important economic and transportation facility utilized by residents of the
borough; and
WHEREAS, public safety concerns dictate that these Lands near the
Lilly Lake be retained in public ownership until alternative facilities can be
developed.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly declares a portion of U.S. Survey 3467 in the vicinity of the dry
dump site as surplus for municipal purposes and directs the mayor to finalize
;I land values and consummate the exchange.
BE IT FURTHER RESOLVED, that the exchange be based on equal property
; value, and costs of a title search surveying, and platting be borne by the
Kodiak Island Borough.
