RESOLUTION MO. 86 -66 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY SETTLING THE
ACCESS DISPUTE WITH TOM HENDEL IN THE AMOUNT OF 86,800.00.
WHEREAS. the Kodiak Island Borough compl.ted construction of the
Beyview Drive Monashka Circle Road in early 1988, and
WHEREAS. Tom Mendel owns Lot 13, Block t of the Monaehka Bay Alaska
Subdivision which fronts on the Monashka Circle Road, and
WHEREAS. at the time of purchasing easements Tom H.nd.l claims that
the Kodiak Island Borough contract and consultant who negotiated the easement
purehas° assured him of driveway access to his lot, and
WHEREAS, the road construction left a 5 foot embankment at th. •dg.
of the road onto the lot, and
WHEREAS, this embankment incr.a... the cost of driveway construction
by 87.200 to 89,600 according to construction bid prides, and
WHEREAS, Tom Hendel has agreed to settle the dispute for 66,800.
NOW, THEREFORE. BE IT RESOLVED by the Kodiak Island Borough Assembly
that the Mayor is directed to issue a check to Tom Hendel in the amount of
66.800 conditioned upon a release of further obligation by the Kodiak Island
Borough, and
BE IT FURTHER RESOLVED that funds to support this settlement Shall
be drawn from the Kodiak Island Und..ignat.d Projects Fund.
