TRANSFER OF FUNDS FROM THE LAND SALE ACCOUNT TO BE USED IN CONDEMIATION
it PROCEEDINGS.
WHEREAS, negotiations have failed to resolve the issue of a purchase
of a right -of -way through U.S. Survey 162 owned by Lynn Canal Investment
Company, and located in Karluk, Alaska; and
Ii
WHEREAS, the Borough is ready to initiate condemnation proceedings
I of this right -of -way under AS 09.55.240; and
WHEREAS, a deposit based upon pon an opinion of value of the taking is
required to be posted with the court; and
WHEREAS, a value of fifty -five hundred dollars ($5,500) has been
i t established by the Borough Assessor /Chief Appraiser as an opinion of value for

this parcel;
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
that it authorized the transfer of $5,500 dollars from the Land Sale Fund to
be utilized as a court deposit for the condemnation of a right -of -way through
U.S. Survey 162, Karluk, Alaska.
