1986-45 Authorizing the Purchase of Additional Right-of-Way for Otter Avenue.A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING THE
PURCHASE OF ADDITIONAL RIGHT -OF -WAY FOR OTTER AVENUE.
WHEREAS, the construction of Otter Avenue encroaches substantially
onto Lot 11A, Block 7, Bells Flats Alaska Subdivision; and
WHEREAS, Otter Avenue is travelled substantially by residents of the
Women's Bay Community; and
WHEREAS, Otter Avenue is a recognized Borough road improved and
maintained by the Women's Bay Service Area; and
WHEREAS, it is desirable to have publically owned roads in public
right -of -ways; and
WHEREAS, Kodiak Island Borough Code Section 3 16 020 requires
Assembly approval prior to said purchase.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly authorizes the Mayor to enter into negotiations for the fee simple
acquisition of that portion of the Otter Avenue right -of -way that encroaches
into said lot subject to the following condition:
Acquisition cost shall not exceed six thousand ($6000.00)
dollars.
