1986-14 Reversing the Planning and Zoning Commission's Decision on Condition 6 in Case # 5-85-055II KODIAK ISLAND BOROUGH RESOLUTION NO. 86 -14 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REVERSING THE ( PLANNING AND ZONING COMMISSION'S DECISION ON CONDITION 6 IN CASE NO. 5 -85 -055 REGARDING THE SUBDIVISION OF LOTS 6 AND 7 U. S. SURVEY 3100 AND LOTS 1 AND 2, iI BLOCK 4, KADIAK ALASKA SUBDIVISION, FIRST ADDITION, TO PEREZ ESTATES SUBDIVISION. WHEREAS, the Kodiak Island Borough Planning and Zoning Commission 1!i granted preliminary approval of Case No. 5 -85 -055, Subdivision of Lots 6 and 7 U. S. Survey 3100 and Lots 1 and 2, Block 4, Kadiak Alaska Subdivision, First H Addition, to Perez Estates Subdivision at its regular meeting of October 16, . and 6, and WHEREAS, that approval was subject to 7 conditions, and WHEREAS, the land owner, Anthony J. Perez, has appealed condition WHEREAS, the Kodiak Island Borough Assembly seated as the Board of I. Adjustment on February 6, 1986 heard the appeal in accordance with Kodiak 1 'F Island Borough Code Title 16. NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly ( that the decision of the P s Z Commission with regard to condition 6 is reversed for the reason that condition 6 is not reasonable because the access would Lend to a nonexistent roadway and adequate access to this small subdivi- sion is provided by the subdivision plan.
