1983-99 Authorizing The Transfer Of Responsibilities Agreement Between The State Of Alaska And The Kodiak Island Borough For The Kodiak Pedestrian/Bicycle Path.A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING THE
TRANSFER OF RESPONSIBILITIES AGREEMENT BETWEEN THE STATE OF ALASKA AND THE
KODIAK ISLAND BOROUGH FOR THE KODIAK PEDESTRIAN /BICYCLE PATH.
WHEREAS, the Kodiak Island Borough (hereinafter called the grantee)
'desires to execute a Transfer of Responsibilities Agreement with the State
of Alaska (hereinafter called the State) Department of Transportation and
Public Facilities for the construction of the Kodiak Pedestrian /Bicycle Path,
,Project No. Ad388 described generally as an asphalted surface pedestrian/
path to run parallel to Otmeloi Point Road from Benny Benson Drive
Ito Monashka Cemetery Road intersection, and
WHEREAS, the Grantee is willing to undertake the performance as
outlined in the Transfer of Responsibilities Agreement (TORA), with the
provision that the length of the project will be determined by the amount of
funds provided by the State, and
WHEREAS, the Grantee has the authority under State Law or local
charter to provide the services for which funds were appropriated, and
WHEREAS, the State has the authority to enter into an agreement
pursuant to AS 35.15.080 et. seq.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough hereby
authorizes the Borough Manager to execute the Transfer of Responsibilities
,Agreement (TORA) for the Kodiak Pedestrian /Bicycle Path but specifically does
not agree to contribute additional funds to the project.
BE IT FURTHER RESOLVED by the Kodiak Island Borough Assembly that
the Borough agrees to accept $620,000 for the construction of the pedestrian/
bicycle path and to administer the construction of the project according to
available funding.
