KODIAK ISLAND BOROUGH
RESOLUTION NO. 83 -83 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY TO EFFECT CERTAIN
BUDGET CHANGES IN THE BONDED CAPITAL PROJECTS FUND.
WHEREAS, Rogers and Babler Inc. has filed a claim against the
Kodiak Island Borough for delay costs associated with the construction of
Main Elementary School, and
WHEREAS, the Contracting Officer has issued a determination that the
claim is not valid, and .
WHEREAS, Rogers and Babler Inc. in accordance with the general
conditions of the contract have requested a hearing by the Kodiak Island
Borough Assembly which is scheduled for September 8, 1983, and
WHEREAS, we anticipate that Rogers and Babler, Inc. will utilize
expert witnesses in the areas of contract administration and construction
practices during their presentation, and therefore, it will be necessary for
us to provide appropriate witnesses to rebut the plaintiff's allegations.
NOW, THEREFORE, BE IT RESOLVED that staff is hereby authorized and
directed to effect the following project level changes:

Undesignated Fund Balance $(30,000)
BE IT FURTHER RESOLVED, that staff is authorized and directed to
1 effect the necessary line item changes within the limits established above
by project to properly monitor and account for the expenditures of these
funds.

the Kodiak Island Borough Assembly.
