1983-55 Affirming A Decision Of The Planning Commission Denying A Sign Variance.r1! 1 0 0 1 0 1 4 6 7 A RESOLUTION OF THE BOROUGH ASSEMBLY AFFIRMING A DECISION OF THE PLANNING COMMISSION DENYING A SIGN VARIANCE. WHEREAS, Jerry Martini applied for a variance to permit an advertising sign to be located on Lot 3, Block 1, Woodland Acres Subdivision; and WHEREAS, the Planning and Zoning Commission held a public hear- ing on the requested variance at its March 16, 1983 meeting and denied same; and WHEREAS, Jerry Martini appealed the Commission's decision to the Borough Assembly and the Assembly, seated as a Board of Adjustment at its May 5, 1983 meeting, held a public hearing on the appeal request. NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly that it hereby affirms the Planning Commission's decision denying Jerry Martini's request for a variance to place an advertising sign on Rural Residential zoned property known as Lot 3, Block 1, Woodland Acres Subdivision. BE IT FURTHER RESOLVED by the Borough Assembly that its denial of Jerry Martini's appeal request is based on the following findings of fact: 1. There are no exceptional physical circumstances or conditions applicable to the property which warrant a variance; 2. The proposed sign location does not comply with Borough Code because it would be located approximately one mile from the home occupation involved and not on the structure containing the business; and 3. A variance cannot be granted because of conditions caused by actions of the person seeking relief or for reasons of financial hardship or inconvenience (Alaska Statutes Section 29.33.11O(C)).
