A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
AWARDING THE CONTRACT FOR CONSTRUCTION OF SERVICE DISTRICT NO. 1
SEWER AND WATER IMPROVEMENTS, PROJECT NO. 82 -1.

WHEREAS, Invitation for Bids for Service District No. 1
and Water Improvements, Project No.
82 -1, were published
on March 9, 16, and 23, 1983, as required by Kodiak Island
Borough Code Section 3.16.040A, and
WHEREAS, the bids were publicly opened at 3:00 p.m.
Wednesday, April 13, 1983, as stated
and
and
WHEREAS, the low four bidders were as follows:
Hollander Construction Co., Inc. $1,956,883
Green Construction Co. 2,516,291
Frank Coluccio Construction Company 2,934,105
Brechan Enterprises, Inc. 2,995,494
WHEREAS, the low bidder, Hollander Construction Co.,
Inc., verbally notified the Borough Engineer at 8:00 a.m. on
Friday, April 15, 1983, that they had made an error in preparing
their bid, and
WHEREAS, such notification was received eighteen (18)
hours after the time set for notification in
for Bidders" contained
WHEREAS, the

at a price adjusted by the claimed amount of error, which would
be $2,299,883., and
WHEREAS, Hollander Construction Co., Inc. has requested
to have their bid withdrawn if award is not made at the adjusted
and
WHEREAS, the Borough Engineer, the consulting firm of
URS Engineers, and the Service District No. 1 Advisory Board all
recommended that the contract not be awarded at the adjusted

figure, and
WHEREAS, the Borough Attorney has reviewed the case
and indicated by letter dated April 20, 1983, that the Borough
could waive the 24 -hour time limit for notification of error and
allow the withdrawal of the Hollander Construction Co., Inc. bid.
NOW, THEREFORE BE IT RESOLVED by the Kodiak Island
Borough Assembly that it is not in the best interest of the
Borough to award the contract to Hollander Construction Co., Inc.
for an adjusted price of $2,299,883., and
BE IT FURTHER RESOLVED that the 24 -hour time limit for
notification of error is waived and Hollander Construction Co.,
Inc. be allowed to withdraw their bid, and
BE IT FURTHER RESOLVED that the bond submitted by
Hollander Construction Co., Inc. be returned to the bidder on the
condition that he not be allowed to participate in construction
of the Service District No. 1 Sewer and Water Improvements
Project No. 82 -1 in any manner, and
BE IT FURTHER RESOLVED the the contract be awarded to
the second low bidder, Green Construction Co., in the amount of
$2,516,291.00.
