A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
APPROVING THE VACATION OF A ROADWAY AND UTILITY RIGHT -OF -WAY
BETWEEN LOTS 7 AND 8 OF U. S. SURVEY 3100.
WHEREAS, the Federal government reserved a roadway
and utility right -of -way not to exceed fifty (50) feet in width
along each side of the common boundary between Lots 7 and 8 of
U. S. Survey 3100 when the lots were patented, and
WHEREAS, the owners of Lots 7 and 8 of U. S. Survey
3100 have petitioned to have the roadway and utility right -of-
way vacated, and
WHEREAS, the Kodiak Island Borough Planning and Zoning
Commission granted final approval to the vacation of the roadway
and utility right -of -way on March 16, 1983, and
WHEREAS, this vacation of land constitutes a disposal
of Borough land subject to the provisions of A.S. 29.33.240(a),
and,
WHEREAS, the Borough Engineer recommends that a utility
easement twenty (20) feet in width be retained along the common
boundary between Lots 7 and 8 of U. S. Survey 3100.
NOW, THEREFORE BE IT RESOLVED by the Kodiak Island
Borough Assembly that the final plat prepared by Roy A. Ecklund,
Registered Land Surveyor, and dated February 4, 1983, is approved
subject to the reservation of a utility easement ten (10) feet
each side of the common boundary between Lots 7 and 8 of U. S.
Survey 3100.
