RESOLUTION NO. 83 -45 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AFFIRMING A
DECISION OF THE PLANNING AND ZONING COMMISISON ON THE SUBDIVISION OF TRACT
A -1, RUSSIAN CREEK ALASKA SUBDIVISION.
WHEREAS, Harry B. Dodge and Kenneth G. Langlois submitted a pro-
posal to subdivide Tract A -1, Russian Creek Alaska Subdivision, into two lots
on November 23, 1982; and
WHEREAS, the Planning and Zoning Commission held an advertised
and notice public hearing on Case S -82 -032 on January 19, 1983 and unanimously
voted to table this item; and
WHEREAS, the Commission reconsidered Case S -82 -032 at its
February 16, 1983 meeting and unanimously voted to disapprove the proposed
subdivision because of anticipated access problems; and
WHEREAS, Mr. Dodge filed an appeal of the Commission's decision
on March 3, 1983; and
WHEREAS, the Borough Clerk has caused a public hearing of the
Borough Assembly, seated as the Board of Adjustment, to be advertised and
noticed for April 7, 1983 on Mr. Dodge's appeal; and
WHEREAS, the Board of Adjustment, on April 7, 1983, conducted
a public hearing on Harry B. Dodge's appeal of the February 16, 1983 Planning
and Zoning Commission decision denying approval of Case S -82 -032, a subdivision
of Tract A -1, Russian Creek Alaska Subdivision, into two lots.
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly, seated as
a Board of Adjustment, that it affirms the Planning and Zoning Commission's
February 16, 1983 decision denying approval of Case S -82 -032, a subdivision
of Tract A -1, Russian Creek Alaska Subdivision, for the following reasons:
1. The proposed subdivision design is not appropriate for the
land involved;
2. The proposed access for Lot A -1B would have a roadway
gradient exceeding 19 percent; and
3. The original subdivision of Tract A -1 was accomplished by
the Borough as a 6 acre parcel because further subdivision was deemed to be
impractical because of the steep topography present.
