KODIAK ISLAND BOROUGH
RESOLUTION NO. 83 -43 -R
WHEREAS, Donald H. Seixas, Jr., submitted a proposal to subdivide
Tract F, Russian Creek Alaska Subdivision, into five lots; and
WHEREAS, the Planning, and Zoning Commission held an advertised
and noticed public hearing on Case S -81 -020 on August 19, 1981 and approved
the preliminary plat of Tract F by a unanimous vote; and
WHEREAS, the Planning and Zoning Commission approved a final
plat of the Tract F subdivision at its December 17, 1981 meeting; and
WHEREAS, Donald H. Seixas, Jr. found it impractical to construct
the public road contained on the approved final plat and subsequently submitted
a revised preliminary plat; and
WHEREAS, the Planning and Zoning Commission held an advertised and
noticed public hearing on Case S -82 -031 at its February 16, 1983 meeting and
unanimously voted to disapprove the revised preliminary plat because the
previous subdivision design was preferred and the proposed "flag" lots were '..
deemed to be undesireable; and
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REVERSING A
DECISION OF THE PLANNING AND ZONING COMMISSION ON THE SUBDIVISION OF TRACT F,
RUSSIAN CREEK ALASKA SUBDIVISION.
WHEREAS, Mr. Seixas filed an appeal of the Commission's decision
on February 23, 1983, in accordance with Borough Code; and
WHEREAS, the Borough Clerk has caused a public hearing of the
Borough Assembly, seated as a Board of Adjustment, to be noticed and advertised
for April 7, 1983, on Mr. Seixas' Appeal; and
WHEREAS, the Board of Adjustment, on April 7, 1983, conducted a
public hearing on Donald H. Seixas, Jr.'s appeal of the February 16, 1983,
Planning and Zoning Commission decision to deny case 5 -82 -031, a subdivision
of Tract F, Russian Creek Alaska Subdivision.
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly, seated
as the Board of Adjustment, that it reverses the Planning and Zoning Commis-
sion's February 16, 1983 decision denying approval of Case S -82 -031, a
subdivision of Tract F, Russian Creek Alaska Subdivision, for the following
reasons:
1. The proposed subdivision design is appropriate for the
bland involved;
2. Dedicated public access, in the form of a cul -de -sac, is not
needed for the proper development of the site; and
received.
3. No public testimony opposing the proposed subdivision was
PASSED AND APPROVED THIS 7th DAY OF April , 1983.
