A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY APPROVING AN
AGREEMENT BETWEEN THE BOROUGH, VETERANS OF FOREIGN WARS POST NO. 7056, AND
TIMBERLINE, INC.
WHEREAS, the Borough is the owner of lands which are presently
leased to the Veterans of Foreign Wars and described as ADL 36049; and
WHEREAS, Section 18.40.110 of Borough Code authorizes subleases
upon receipt of prior written approval from the Borough; and
WHEREAS, a previously existing road on the VFW's leased land was
improved by Timberline, Inc. for the purpose of transporting logs from a
beach to the Monashka Bay Road; and
WHEREAS, an agreement between the Borough, the VFW, and Timberline
Inc. has been proposed as a method of formalizing the use of the land for the
movement of the logs.
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly that it
approves the proposed agreement, with the following conditions and
authorizes the Borough Manager to sign said agreement on the Borough's behalf:
1. Term of the agreement is for 2 years;
2. All State and Federal permits required for the log moving
operation will be obtained by Timberline, Inc.; and
3. Borough will be held harmless from any liability for injury,
death, or damages resulting from Timberline, Inc.'s use of the property.
