RESOLUTION NO. 83 -27 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING A
SHORT TERM EXTENSION OF A PREVIOUSLY AUTHORIZED LEASE TO CALVIN HUGGARD.
WHEREAS, Hazel Nixon received Assembly approval for a five year
renewable lease on June 21 and October 4, 1973; and
WHEREAS, a lease document does not appear to have been executed;
WHEREAS, Calvin Huggard has been residing on the Borough property
known as the Nixon Ranch for the past five years and desires to continue said
residency; and
WHEREAS, the Borough Assembly, at its January 13, 1983 work session
with the Planning and Zoning Commission, suggested an extension of the previ-
ously authorized lease for a two year period or until a land sale involving the
"Nixon Ranch" occurs; and
WHEREAS, the Planning and Zoning Commission held a public hearing
at its February 16, 1983 meeting on Calvin Huggard's request to lease the 11
acres known as the Nixon Ranch and adopted Resolution Number 82 -113 recommend-
ing approval of a lease extension.
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly that the
administration is authorized to enter into a lease agreement with Calvin
Huggard as an extension of Hazel Nixon's previously authorized lease on an
11.2 acre parcel located in Section 2, Township 29 South, Range 21 West, Seward
Meridian, with the following conditions:
1. The property is to be used only for general agricultural
purposes and as a place of residence for the Huggards;
2. Any unauthorized residential structures on the property shall
be removed and /or vacated not less than ninety (90) days after lease execution;
3. Any abandoned vehicles present on the property shall be removed
not later than ten (10) days after lease execution;
4. No construction of new buildings is permitted;
5. Lease shall not be assignable;
6. Any taxes due to the Borough be paid, or suitable arrangements
for payment be made, prior to execution of the lease;
7. Lease term is for two (2) years or until a land sale involving
the property occurs; and
8. Annual rental shall be $1,000.00.
