A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING A
CONDITIONAL LEASE FOR A NON- PROFIT SALMON HATCHERY ON SHUYAK ISLAND.
WHEREAS, Wayne Treat is the owner of U.S. Survey 2932 on Shuyak,
the site of the Port Williams cannery; and
WHEREAS, Wayne Treat is seeking the use of adjacent lands for the
purpose of establishing a non - profit salmon hatchery and protecting the
operation when established; and
WHEREAS, the adjacent lands are under the jurisdiction of the
Kodiak Island Borough and in accordance with Borough Code the proposed disposal
was reviewed by the Planning and Zoning Commission at its January 19, 1983
meeting; and
WHEREAS, the Commission recommended a conditional lease for 25
years on land described as '50 feet on either side of the unnamed stream enter-
ing Port Williams lagoon to and around its source, the unnamed lake in Section
13, T19S, R2OW, S.M., and extending along the shoreline of the lagoon to a point
100 feet before reaching the cabin located on U.S. Survey 1738.
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly that it
authorizes staff to enter into a 25 year negotiated lease on the property des-
cribed above, with the following conditions:
1. Lease execution depends on final approval of the hatchery by
the Alaska Department of Fish and Game;
2. The documentation of non - profit status required by Section
18.40.020(C) of Borough Code be provided upon execution of the lease;
3. The lease be evaluated annually;
4. The lease not be assignable;
5. The only land use allowed will be a non - profit salmon hatchery;
and
