RESOLUTION NO. 83 -12 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REOUESTING AN
EXTENSION OF ALASKA STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION COMPLIANCE
DATE FOR RIO -DRY INC. AT KODIAK, ALASKA.
WHEREAS, the economy of Kodiak Alaska, designated the number one
seafood seaport in the United States by NMFS, is predominantly supported by
seafood harvest and processing, and
WHEREAS, Kodiak's processed seafood production depends upon
efficient seafood waste products handling, and
WHEREAS, there currently exists in Kodiak, only one seafood waste
disposal plant, to wit, Bio -Dry, Inc., and
WHEREAS, Bio -Dry, Inc. is anticipating an Alaska State Department of
Environmental Conservation (DEC) closure notice effective January 1983 for
compliance failure, and
WHEREAS, the citation received by Rio -Dry, Inc. pertained to air
odor quality and sanitation (i.e. winged insects /flies), both of which occur
during warm weather and stationary air mass conditions, and
WHEREAS, the anticipated weather conditions during the next 180 days
(January through June, 1983) are predominantly neither warm nor calm as
recorded by the U. 5. Weather Service (NOAA), and
WHEREAS, the alternative fish waste handling methods are to
discharge screened waste into the immediate harbor, and to dump solid wastes
in designated disposal areas in close proximity to St. Paul Harbor, and
WHEREAS the aforesaid solid fish waste disposal is not cost
effective and will result in Kodiak's seafood processors' plants shutdown, and
WHEREAS, processors' plants shutdown will severely impact the Kodiak
economy and the already weakened Alaska State fishing industry, and
WHEREAS, the Kodiak Island Borough, while not condoning the
compliance failure of Bio -Dry, Inc., believes the continued operation is
critical to the economic survival of Kodiak and the Alaska State fishing
industry, and
WHEREAS, it is our understanding that there are several parties
'interested in purchasing the Bio -Dry operation and bringing it into proper
operating compliance, and

WHEREAS, said continued operation of Bio -Dry, INc. will not
adversely affect local air quality or sanitation for the next six (6) months
due to historically prevailing weather conditions,
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly on behalf of the Kodiak Seafood Processors Association, hereby
requests the Alaska State Department of Environmental Conservation to extend
the compliance deadlines date for Bio -Dry, IN.c from January 1, 1983 to July
1, 1983, and
BE IT FURTHER RESOLVED, that copies of this resolution be forwarded
to:
