A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING A
PUBLIC INTEREST LEASE TO B.P.O.E. LODGE #1772 ON TRACT B, MILLER POINT ALASKA
SUBDIVISION.
WHEREAS, a request to lease certain Borough lands for scouting and
';youth group activities was received from B.P.O.E. Lodge #1772; and
WHEREAS, the Planning Commission reviewed the request, in accordance
with Title 18 of Borough Code, at its August 18, 1982 meeting, and recommended
that the land be declared surplus to Borough needs and leased to the Elks with
conditions.

RESOLUTION NO. 82 -62 -R
NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly that it
authorizes the administration to negotiate a public interest lease with B.P.O.E.,
Lodge #1772 for 36 acres of land known as Tract B, Miller Point Alaska Subdivis-
ion, with the following conditions:
1. The land is to be used for scouting and related youth group
activities;
2. Lease term is twenty -five (25) years;
3. Annual rental fee is $1.00;
4. Area shall be open to the public but with its use scheduled by
the Elks;
5. No fences are to be erected on the property;
6. No trees larger than eighteen (18) inches in diameter, lakes or
wetlands are to be disturbed; and
7.
