DISPOSAL OF BOROUGH LAND AND A MATERIAL SALES CONTRACT FOR THE CITY OF KODIAK'S
MONASHKA CREEK RESERVOIR PROJECT.

land known as the Vista View Borrow Area in the Ell of the E; of Section 24,
T275, R2OW, S.M., for use in the Monashka Creek Reservoir project; and
WHEREAS, Title 18 of Borough Code authorizes the temporary use of
land and materials for public purposes; and
WHEREAS, the Planning and Zoning Commission conducted a noticed and
advertised public hearing on the request at its April 28, 1982 meeting; and
WHEREAS, the Commission found the land surplus to the Borough's
,needs and recommended approval of the City of Kodiak's request.
NOW, THEREFORE ,BE IT RESOLVED that the Borough Assembly authorizes
the City of Kodiak to use the Vista View Borrow Area in the El, of the Ell of
Section 24, T275, R2OW, S.M., for the removal of 26,000 cubic yards of fill and
rip -rap material for the Monashka Creek Reservoir project and authorizes the
administration to enter into a material sales contract for the fee of $1.00
with the following conditions:
1. City of Kodiak is responsible for the mining activity to be
accomplished and restoration of the site following project completion; and
2. City of Kodiak notify the Borough, in writing, upon completion
of site restoration.
