'I BY: KODIAK ISLAND BOROUGH RESOLUTION NO. 82 -5 -R BOARD OF ADJUSTMENT, ONNTHE MICHAELIANDIVI OLET B ROCK G SUBDIVISION APPEAL AS THE ASSEMBLY, SEA WHEREAS, the Kodiak Island Borough Planning and Zoning Commission, j at its October 21, 1981 meeting held a properly advertised, noticed and con - ? ducted public hearing on Case S - 81 -022, the Miller Point Alaska, into lots 4A -1 and 4A -2; and of of lot 4A, block 3, WHEREAS, the proposed subdivision was approved by the Commission with the following conditions: (1) that the nonconforming accessory building located on proposed lot 4A -1 be removed prior to submission of the final plat; and (2) that the lot line between lots 4A -1 and 4A -2 be straightened to connect between monuments; and WHEREAS, the Borough Assembly, seated as the Board of Adjustment, held a properly advertised and conducted public hearing on the appeal request at its December 3, 1981 meeting. NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough Assembly, seated as the Board of Adjustment, affirms the October 21, 1981 decision of the Planning and Zoning Commission for the following reasons: 1. The nonconforming use would violate setback requirements; 2. Adherence to adopted regulations; 3. Lack of dedicated access; and 4. The subdivision creates a nonconforming use.
