i WHEREAS, Title 16.12.050 of the Kodiak Island Borough Code of

; Ordinances and Resolutions provides that a final plat shall be approved by the 1
( 'Borough Assembly by Resolution, which Resolution shall provide for the acceptance
I I of all streets, alleys, easements and other open spaces dedicated to public II
; purposes. And;
WHEREAS, the final plat was presented for approval by Mr. Ed Opheim.'

WHEREAS, the Planning and Zoning Commission granted final approval

, of said final plat on February 20, 1980.
NOW THEREFORE BE IT RESOLVED that the Kodiak Island Borough Assembly)
[' grant final approval to the final plat presented by Mr. Ed Opheim, and that all I
',streets, alleys, easements and other open spaces on the same plat are hereby
I
Iaccepted subject to the following conditions:
,,'III 1) Waiver of the requirement that all roads within the subdivision
I be dedicated.
2) Require a note on the plat stating legal access to all lots within
I I the subdivision shall be provided by public use easements sixty
II (60) feet in width.
1 1 1 3) Deletion of the note on the plat restricting use of the easements
i for the exclusive use of the owners of property within the sub-
division.

l 4) And granting of a variance from the improvement requirements set
forth in Title 16 section 16.24 of the Kodiak Island Borough Code'
of Ordinances.
