A RES:T:37. TO RENEW A. BORROW -EASE (x.329 ON 2ARCE -S
3 -3 AND 3 -4.
WHEREAS, the Kodiak Island Borough entered into a on= _ -'-
borrow lease with 3reohan Enterprises, Inc. on February 9, 12
for Parcels 3 -3 and 3 -4 of Tract 3, Sells Flats Alaska Subdiv-s' -cn;
and,
WHEREAS, a one year renewal was granted for both parcels in
1979, and a third renewal was requested in February, 1979; and,
WHEREAS, to the two years tine approximately 3,000 - • c r.-
:yards of material was removed from Parcel 3 -4 and none from —2
3-3; and,
"WHEREAS, the lease contract Provides for four ore -year
renewals of a one year gravel lease if the lessee has net
of the lease for the previous year; and,
WHEREAS, the lease ccn:raot further provides that the
! renewal of the contract_ not be made if the lessee fails t_ occupy
and use the premises for a period of six consecuti
!longer, and,
WHEREAS, the renewal fees of S1,200 far each lease have been
held by the borough since February, 1979 and no action has been
��taken on the renewal request during the 1979 construction season.
NOW, THEREFORE BE IT RESOLVED that the Kodiak Island Borough
! Assembly directs the Borough Manager to:
1. Renew for one year the borrow lease agreement
for Parcels 3 -3 and 3 -4. This renewal is to be
effective from February 9, 1990 through February
8, 1931.
2. Condition the ren_Na1 :he lease for
Parce 3 -3 and 3 by =id d'- ng the following

fee shall be based on the assessed
