(Kodiak Electric Association)1 1 , ATTEST: o/ 4 C erk- i easurer WHEREAS, the Planning and Zoning Commission recommended this request be approved during their regular meeting held on November 21, 1979. And; WHEREAS, the Borough Assembly finds granting this request would be in the best interests of the citizens of the community as it will provide better power service for the Bells Flats /Russian Creek Alaska Subdivision. NOW THEREFORE BE IT RESOLVED by the Kodiak Island Borough Assembly that the following described powerline easement requested by Kodiak Electric Association is approved: A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY GRANTING A POWER - LINE EASEMENT TO THE KODIAK ELECTRIC ASSOCIATION ACROSS LANDS SELECTED AND TENT- ATIVELY APPROVED TO THE BOROUGH. (Kodiak Electric Association) WHEREAS, the Kodiak Electric Association has submitted a request for a one hundred (100) foot wide powerline easement on Borough selected lands in the Bells Flats /Swampy Acres Area. And; WHEREAS, this request has been reviewed by the Borough's Land Managef ment Consultant who has not indicated any objection to the request. And; I 1 i r KODIAK ISLAND BOROUGH RESOLUTION NO. 79 -64 -R A right -of -way being a total of one hundred feet (100') wide, fifty feet (50') on each side of the following described centerline, and located within the U.S. Survey No. 2539, Alaska, situated within protracted Township 28 South, Range 20 West, Seward Meridian, Alaska, and being within the Kodiak Recording District, Third Judicial Dis- trict, State of Alaska. Commencing at corner no. 4 of the U.S. Survey 2539, Alask proceeding N. 57 54' 42" E. a distance of 10,112,88 feet more or less, to a pint of intersection with the meander line of lot 5, block 3, of Bells Flats Alaska Subdivision (Plat 69 -4, Kodiak Recording District). Thence N. 02 21' 01" E. a distance of 110.0 feet, more or less across Sargent Creek to a point of its northerly mean high waterline, and the TRUE POINT OF BEGINNING. Thence continuing N. 02 21' 01" E. a distance of 2,211.2 feet, more or less, to a point of intersection with the southerly boundray of Parcel No. 1 of Public Land Order No. 5566, said point of intersection being the terminus of the herein described right -of -way. It is intended that the right -of -way boundaries be pro- longed or shortened as necessary to maintain the 50 feet on each side of centerline, and to complete the intersections with the aforesaid lot 5, block 3 of Bells Flats Alaska Subdivision and Parcel 1 of Public Land Order No. 5566.
