A RESOLUTION OF KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING
A NEGOTIATED LEASE TO KMXT RADIO STATION FOR AN ANTENNA SITE AS
PROVIDED IN SECTION 18.40.020(8) OF THE CODE OF ORDINANCES
WHEREAS, the Kodiak Island Borough is the managing operator
of Lots 5 and 7 of U. S. Survey 2538A and all the improvements
thereon, and,
WHEREAS, the property deed contains a restrictive clause
limiting the property use to school and other public purposes
only, and,
WHEREAS, KMXT Radio Station is a non - profit organization
and meets the public purpose use as a public broadcasting radio
station, and,
WHEREAS, KMXT Radio Station has requested approximately 600
, square feet of Lot 5 on which to construct and operate a satellite
receiving station, and,
WHEREAS, Section 18.40.020(8) of the Kodiak Island Borough
,'Code of Ordinances provides for negotiated leases to qualifying
non- profit corporations or public utilities, at a reasonable rental .
rate, taking into consideration the purpose for which the real
property is to be used,
NOW THEREFORE BE IT RESOLVED the Kodiak Island Borough
Assembly authorizes a ten and one -half year negotiated lease be
offered to KMXT Radio Station for approximately 600 square feet o
land located within Lot 5 of U. S. Survey 2538A as provided in
18.40.020(B) of the Kodiak Island Borough Code of Ordinances. The
annual rent shall be Ten Dollars ($10.00).
