A RESOLUTION OF KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING
CIA NEGOTIATED LEASE TO KMXT RADIO STATION FOR AN ANTENNA SITE AS
ROVIDED IN SECTION 18.40.020 OF THE CODE OF ORDINANCES
it WHEREAS, the Kodiak Island Borough is the managing operator
iof Lots 5 and 7 of U. S. Survey 2538A and all the improvements
(thereon, and,
WHEREAS, the property deed contains a restrictive clause
L ' limiting the property use to school and other public purposes
nly, and,
WHEREAS, KMXT Radio Station is a non - profit organization and
;meets the public purpose use as a public broadcasting radio
J and,
WHEREAS, KMXT Radio Station has requested approximately 600
'square feet of Lot 5 on which to construct and operate a radio
it
transmitter site, and,
I! WHEREAS, Section 1 8.40.020 of the Kodiak Island Borough Code
rof Ordinances provides for a negotiated lease when the term does
it
,i ;not exceed five years, the annual rent does not exceed $500, and
I
!there is no competitive interest for the real property,
NOW THEREFORE BE IT RESOLVED the Kodiak Island Borough
ssembly authorizes a five year negotiated lease be offered to KMXT
Radio Station for approximately 600 square feet of land located

ithin Lot 5 of U. S. Survey 2538A as provided in 18.40.020 of the
Kodiak Island Borough Code of Ordinances. The shall ,
eight percent of the land value.
