1979-20 Approving The Vacation Of A Portion Of The South Fifth Avenue Right-Of-Way. (Miller/Doubt)n A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY APPROVING THE VACATION '' OF A PORTION OF THE SOUTH FIFTH AVENUE RIGHT -OF -WAY. (MILLER AND DOUBT) WHEREAS, Title 16.12.050 of the Kodiak Island Borough Code of Ordinances and Resolutions provides that a final plat shall be approved by the Borough I Assembly by Resolution, which Resolution shall provide for the acceptances of all streets, alleys, and easements, and other open spaces dedicated to public purposes, and, WHEREAS, the final plat has been presented for approval by JIM and MARGARET MILLER and RON and MARY DOUBT, and, WHEREAS, the Planning and Zoning Commission granted approval on said final plat on February 21, 1979. NOW THEREFORE, BE IT RESOLVED that the Kodiak Island Borough Assembly grant approval to the final plat presented by JIM and MARGARET MILLER and RON and MARY DOUBT as shown on the plat prepared by Roy A. Ecklund, Registered Land Surveyor, and that all streets, alleys, easements, and other open spaces shown on the same plat are accepted subject to the following stinulation: 1) that a five foot (5') walkway and utility easement be retained on each side of the property line which is coterminus with the existing Fifth Avenue right -of -way center line.
