A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY GRANTING A WAIVER
OF THE PLATTING REQUIREMENTS OF SECTION 16.04.130 (b) OF THE KODIAK ISLAND
I BOROUOGH CODE OF ORDINANCES.
WHEREAS, a petition was received from the Ouzinkie and Afognak Native
Il Corporations requesting a waiver of the platting requirements of Title 29,
Alaska State Statutes, Subsection 29.33.170 (a) and Section 16.04.130 (d)

of the Kodiak Island Borough Code of Ordinances, and;
l i WHEREAS,the waiver was requested in order to accommodate an exchange
I lof lands between the two property owners, and;
WHEREAS, the Assembly found the exchange involved several square miles

li of land, that there were no eminent development plans for the property and
the exchange was in the best interest of the parties involved, and;
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission
Ilduring a Special Meeting held on February 7, 1979, approved this request as
jiset forth in their Resolution No. S -79 -004, and;
' WHEREAS, the Assembly found an agreement has existed between the two
(;parties stating if the other were to receive certain land resulting from land

i lsettlements under the Alaska Native Claims Settlement Act they would exchange
i.
('.said land, and;
WHEREAS, the Assembly finds the provisions of Title 29, Section 29.33.
1170 (a) have been met, and;
WHEREAS, the Assembly finds this request would not conflict with the
platting requirements of the Kodiak Island Borough Code of Ordinances, and
further would not affect any property owners other than the two corporate
entities.
NOW, THEREFORE BE IT RESOLVED by the Kodiak Island Borough Assembly that
the Assembly grants this request for a waiver of the Kodiak Island Borough
ode of Ordinance requirement to plat.
