RESOLUTION NO. 78 -57 -R
A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH!
APPROVING THE FINAL PLAT OF THE VACATION OF LOT 10, BLOCK 1, RUSSELL
ESTATES AND A PORTION OF UNSUBDIVIDED U. S. SURVEY 1396 AND REPLAT
TO LOT 10 A, BLOCK 1, RUSSELL ESTATES. (Fedon J. Capas)
WHEREAS, Title 16.12.050 of the Kodiak Island Borough
Code of Ordinances and,Resolutions provides that a final plat shall
be approved by the Borough Assembly by Resolution, which Resolution
shall provide for the acceptances of all streets, alleys, and
easements, and other open spaces dedicated to public purposes,
WHEREAS, the final plat has been presented for approval
by FEDON J. CAPAS, and
WHEREAS, the Planning Commission seated as a platting
board denied the request for subdivision, and
WHEREAS, on appeal the Kodiak Island Borough Assembly
was seated as a platting board, and
WHEREAS, the platting board's decision was appealed to
the Kodiak Island Borough seated as a platting board.
WHEREAS, the Borough Assembly, on appeal from the
platting board, granted approval of said final plat on August 23,
1978.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island
Borough Assembly grant approval to the final plat presented by
FEDON J. CAPAS as shown on the plat prepared by Roy A. Ecklund,
Registered Land Surveyor, dated June 30, 1978 and that all streets,,
alleys, easements, and other open spaces shown on the same plat
are hereby accepted.
