A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY REQUESTINJ
THE LOCAL BOUNDARY COMMISSION TO DENY THE PETITION FOR THE DEVELOP-
MENT CITY OF AFOGNAK AS PETITIONED BY THE AFOGNAK NATIVE CORPORA-
TION ON NOVEMBER 7, 1977.
WHEREAS, on November 7, 1977, the Afognak Native Corporation
submitted a petition'to the Department of Community and Regional
Affairs requesting the incorporation of a Development City of
Afognak in accordance with Title 29 of the Alaska Statutes; and
WHEREAS, the Department of Community and Regional Affairs
and the Local Boundary Commission made decisions to approve the
petition based on the sole submission of the applicants material
in the
petition and the assumption of the Kodiak Island Borough en+
dorsement of such a petition as stated in a letter dated July 21, j
1977; and
WHEREAS, the Development City of Afognak petition was not
presented to the Kodiak Island Borough Assembly prior to the
Borough letter dated July 21, 1977, and the request made to the
Kodiak Island Borough Assembly was only to solicit support for
Afognak to organize as a municipal entity with no indication as
to specific class of city, boundary limits or indication of in-
volvement for such incorporation by property owners in the general
area; and
WHEREAS, the Kodiak Island Borough letter of July 21, 1977,
gave only conceptual approval to entertain the idea of a munici-
pality forming within the Kodiak Island Borough with the assump-
tion that less than four sections of land would be involved,
that a second class city would be proposed because of the lack
of population in the area, and having no other information base;
and
WHEREAS, the Local Boundary Commission is now considering
additional information prior to making a final determination on
the petition and has asked for a clarification of the Kodiak
Island Borough's concerns regarding the petition;

NOW, TB:$REFORE, BE IT RESG; that the Kodiak Island
Bo %agb Assembly by this resolution requests that Local Boundary
Commission deny the approval of the ocveiopment CitJ <:; Afognak
as petitioned by the Afognak Native Corporation. This resolution
requesting denial 1s based upon the following criteria:
1. The municipal services to be provided by the proposed
city can be provided by the Kodiak Island Borough through the
formation of a service district or districts.
2. The planning and zoning authority that would vest with
the development city during the five year formation period con-
flicts with the existing authority of the Kodiak Island Borough
for the same responsibility and if allowed will have to be re-
assumed by the Kodiak Island Borough after the five year develop-
ment period and adjusted to conform to existing Borough criteria
and ordinances.
3. General obligation bonds incurred by the development
city will become obligations of all the borough taxpayers without
a vote of the taxpayers.
4. Schools in the development city and their operations
will become a burden of all the Kodiak Island Borough taxpayers
at a time that may be premature relative to what appropriate
Borough planning may dictate.
5. A petition for a second class city by 25 or more residents
of the area on a more limited scale could accomplish the same and
provide for local representation.
6. The area petitioned for the development city exceeds
any reasonable boundary imaginable within an organized Borough.
If this size development city is to be allowed then consideration
must be given to expanding the adjacent City of Ouzinkie to pro-
vide the local municipal function.
7. No demonstration has been made to the Kodiak Island
Borough that the proposed development will take place and that
the resulting liabilities to be incurred will not become a burden
of the Kodiak Island Borough at the end of five years.

8. The Local Boundary Commission has not approached the
Kodiak Island Borough to advise and determine the effects and
impact the proposed development city would have on the Borough.
