RESOLUTION NO. 78 -26 -R
A RESOLUTION OF KODIAK ISLAND BOROUGH OPPOSING THE LAND
ALLOCATION FORMULA AND OTHER TERMS OF THE MUNICIPAL LAND SELECTION
BILL.
WHEREAS, the Kodiak Island Borough is authorized to make
certain land selections under Alaska Statutes 29.18.190-200; and
WHEREAS, legislation has been introduced by the State which
sought to remove some of the uncertainties in the Municipal Land
Selection Law and to provide for a final determination as to
other factors; and
WHEREAS, the Kodiak Island Borough was desirous of legisla-
tion which would insure the equitable settlement of land selection
problems within the Kodiak Island Borough; and
WHEREAS, the Kodiak Island Borough has taken part in coopera
tive efforts to attempt to formulate legislation which would pro-
tect both the Borough's and native corporations' statutory rights;
and
WHEREAS, certain issues have arisen which appear to be un-
dissolvable and for which the Borough determines to be critical to
its approval including the number of the total acres which should
be available for selection, the inclusion of grazing lands within
the restrictive classification of lands to be available for
selection and the inability of the Borough to benefit from the
in -lieu payment provision as presently contained in the proposed
legislation.
THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
after having reviewed the proposed legislation, having conferred
with its staff consultants including their land and legal person-
nel. and being convinced that the legislation in its present form
fails to adequately protect the rights of residents of Kodiak
Island Borough, hereby, elects to voice its opposition to the
legislation in its present form.
