1973-17 Vacating A Portion Of U.S. Survey 3218 Adjacent To Lot 2, Block 1, First Addition, Holland Acres Subdivision And Replatting1 ) ! ` 1 ; n KODIAK ISLAND BOROUGH RESOLUTION NUMBER 73 -17 -R A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK ISLAND BOROUGH VACATING A PORTION OF U. S. SURVEY 3218 ADJACENT TO LOT 2, BLOCK 1, FIRST ADDITION, HOLLAND ACRES SUBDIVISION AND REPLATTING THE SAME PARCELS TO LOT 2A, BLOCK 1, HOLLAND ACRES SUBDIVISION, U. S. SURVEY 3218. WHEREAS, JOHN FRAY, Baranof Heights, Inc., and ART ZIMMER have petitoned the Planning and Zoning Commission for the vacation of a portion of U. S. Survey 3218 in order to arrange for sale of such property and by such sale to clear the encroachment presently occupying the unsubdivided portion of U. S. Survey 3218, and WHEREAS, all persons were notified that a public hearing would be held on said petition on Wednesday, February 21, 1973, at 7:30 o'clock p.m. in the District Courtroom of the State Office Building before the Kodiak Island Borough Planning and Zoning Commission, which public hearing having been filed herein, and a copy of the Affidavit of Publication having been filed herein, and at which hearing the Planning and Zoning Commission recommended that the above - described lots be vacated and replatted to Lot 2A, Block 1, Holland Acres Subdivision, First Addition and the Kodiak Island Borough being full advised in the premises; NOW, THEREFORE, BE IT RESOLVED that the un- subdivided portion of U. S. Survey 3218 described as: Beginning at a corner common to Tracts J, K and Lot 2, Block 1, Holland Acres Subdivision, First Addition, U. S. Survey 3218; Thence N 32 ° 58'30" E, 187.47 feet along the Westerly boundary of Tract J; Thence N 31 ° 05'00" W, 195.46 feet; Thence S 58 ° 55'00" W, 325.22 feet to a P.C. of a tangent curve to the left thru a central angle of 90 ° 00' having a radius of 20.00 feet, arc distance 31.42 feet; thence the following courses along the easterly R.O.W of Island Lake Road, S 31 ° 05'00" E, 73.67 to a P.C. of a tangent curve to the Right thru a central of 44 ° 11'50 ", radius 196.42, arc distance 151.52 feet; thence S 13 ° 06'50" W, 130.24 feet to a corner common to Lot 1, and Lot 2, Block 2, Holland Acres Sub- division, First Addition. Thence S 76 ° 53'10" E, 16.99 feet to Southerly most corner Tract K, Thence N 48 ° 25'32" E, 315.62 feet along the Northerly boundary of Tract to the POINT OF BEGINNING. be and the same is hereby vacated and replatted into Lot 2A, Block 1, Holland Acres Subdivision, First Addition pursuant to the Plat prepared by Roy A. Ecklund, Registered Surveyor, dated May 26, 1973 and that the Kodiak Island Borough accept said replat in accordance with Section 40.15.140 through 40.15.180, Alaska Statutes, and accept all streets, alleys and easements, and other open spaces dedicated to public purposes as set forth in said replat.
