MOORS • NORMAN kTTORxsW AT LAW 717 It R[fn NCMORR0R 0 0001 (*071 274 -1000 1 1 1 i _ 7 KODIAK ISLAND BOROUGH RESOLUTION NO. 73 -15 -R A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK ISLAND BOROUGH PROPOSING REMEDIAL ACTION TO REMOVE EXISTING JURISDICTIONAL OR POLITICAL CONSTRAINTS TO THE DEVELOPMENT OF A REGIONAL SEWERAGE SYSTEM. WHEREAS, the City of Kodiak has made application to the Environmental Protection Agency and the Alaska Department of Environmental Conservation for grants for the construction of a sewage treatment plant and interceptors to serve the City and the immediately surrounding area; and, WHEREAS, the Environmental Protection Agency has promulgated certain requirements which must be satisfied to establish eligibility for grants, including a requirement that the Kodiak Water Quality Management Plan be a Regional Plan; and, WHEREAS, the development of a regional sewage collection and treatment system would be most feasible and would produce the lowest unit costs; and, WHEREAS, the Kodiak Island Borough is willing to commit itself to the support of the development and implementation of the City of Kodiak water pollution control program; and, WHEREAS, the Kodiak Island Borough has not yet acquired the authority or developed the administrative mechanism for implementing a regional sewerage system; NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly; THAT the Kodiak Island Borough will proceed with all due diligence to evaluate the best method for acquiring the authority necessary to coordinate with the City of Kodiak for the provision of regional sewage treatment and collection COLC. RHODES • NORMAN AMTORNws AT BAR 717 N StR {Q 19471 174.11170 facilities for the City of Kodiak and the immediately surrounding area, and will follow all established procedures necessary to the acquisition of that authority, and BE IT FURTHER RESOLVED: That the Kodiak Island Borough will actively pursue, upon acquisition of the necessary sewerage authority, an agreement with the City of Kodiak whereby the city will provide operation and maintenance service to Borough sewerage facilities, and provide treatment of sewage originatingm the service area of the Borough, or providing for the construction ownership and operation by the City of Kodiak of sewerage facilities in the area outside of the City of Kodiak.
