A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK
ISLAND BOROUGH DECLARING CERTAIN REAL PROPERTY SURPLUS TO THE
BOROUGH'S NEEDS AND AUTHORIZING ITS TRANSFER AND CONVEYANCE
I TO THE STATE OF ALAKSA
WHEREAS, the Kodiak Island Borough is the owner of a
tract of land within the Kodiak Island Borough, described as:
All that portion of Tract "G" of the Russian Creek,
Alaska Subdivision, lying within the unsurveyed
Section 31, T 28 S, R 20 W, SM, Kodiak Recording
District, Third Judicial District, State of Alaska,
more particularly described as follows:
Beginning at a point on the line common to the
Easterly line of said Tract "G" and the Westerly
R.O.W. line of the Cape Chiniak Road, said point
being N 1 3 ° 24'34" E, 373.10 feet from the most
Southerly corner of said Tract "G "; thence,
continuing N 1 3 ° 24'34" E, 62.19 feet, along said
common line, to a point of curve; thence,
continuing along said common line, on a curve to
the right (radius equals 1091.74 feet) through
an arc of 2 5 ° 18'30 ", for a distance of 482.24
feet; thence from a tangent that bears M 38 °43'
04" E, along a curve to the left (radius ecuals
30 feet) through an arc of 47 ° 36'59 ", for a
distance of 24.93 feet; thence from a tangent that
bears S 39 ° 52'13" W, along a curve to the left
(radius equals 1101.74 feet) through an arc of 19°
24'17 ", for a distance of 373.14 feet; thence
N 69 ° 32'05" W, 30 feet; thence S 1 9 ° 11'59" W, 50
feet; thence S 7 2 ° 03'58" E, 30 feet; thence from
a tangent that bears S 17 ° 56'02: W, along a curve
to the left (radius equals 1101.74 feet) through
an arc of 4 ° 31'30 ", for a distance of 87.0 feet;
thence S 13 ° 24'34" W, 62.19 feet; thence S 76 ° 35'
26" E, 10.0 feet to the point of beginning,
containing 0.163 acres, more or less. Basis of
bearings for this description from the Russian
Creek, Alaska Subdivision being known and described
as Project 5- 0391(4), Kodiak N.A.S -Bruhn Pt. Parcel
No. 2.
WHEREAS, the State of Alaska Department of Highways
requests transfer of the lands above described for an additional
right of way for Highway Project 5 0391(4) Kodiak N.A.S. - Bruhn
Point, and claims that it is necessary due to the narrow right
of way in the vicinity of Russian Creek, Alaska Subdivision,
which does not allow horizontal safety clearance for the Coast

Guard's aerial power and telephone facilities, and
WHEREAS, the Kodiak Island Borough has had the same
appraised, the same being valued at
92x00 DOLLARS, and the Borough having the
i authority under Chapter 6, Subchapter 3 of the Kodiak Island
Borough Code of Ordinances and Resolutions, to transfer lands
or permit their use to any State or Federal agency or political
subdivision of the State, and
WHEREAS, the transfer of this property to the State of
Alaska Department of Highways would be in the best interests of
the public and community.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island
Borough Assembly that the following described parcel of land
situated in the Kodiak Recording Precinct, Third Judicial
District, State of Alaska, to -wit:
All that portion of Tract "G" of the Russian Creek,
Alaska Subdivision, lying within the unsurveyed
Section 31, T 28 S, R 20 W, SM, Kodiak Recording
District, Third Judicial District, State of Alaska,
more particularly described as follows:

Borough's needs, and that it would be in the best interests of
;I the public if the same were to be transferred to the State of
flAlaska Department of Highways at less than its appraised value,

�Iright of way of the Cape Chiniak Road, to allow horizontal

j safety clearance for the Coast Guard's aerial power and telephone
facilities, and the Borough Chairman is hereby authorized to
transfer and convey the same and execute a Deed to the State of
I � Alaska Department of Highways for said purposes, pursuant to this
it Resolution.
