1972-39 Declaring Certain Real Property Surplus To The Borough's Needs And Authorizing It's Sale.II 1lk ! f r 1 '] Page One, RESOLUTION NO. 72 -39 -R KODIAK ISLAND BOROUGH RESOLUTION NUMBER 72 -39 -R II A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK it ISLAND BOROUGH DECLARING CERTAIN REAL PROPERTY SURPLUS TO THE 4 BOROUGH'S NEEDS AND AUTHORIZING ITS SALE WHEREAS, the Kodiak Island Borough is the owner of of the Kadiak Alaska Subdivision, containing a tract of land situated in U. S. Survey No. 3469, being a portion �� 9.75 acres, more or i I I less, which is needed by the State of Alaska for il public highway Purposes in connection of the Kodiak - Mill Bay Road Project h being planned by the State Division of Highways, and II . WHEREAS, Chapter 6, Section 3 of the Kodiak Island I iI Borough Code of Ordinances and Resolutions permits the Borough to I ;I transfer lands to the State for less than the a ppraised value 1! when it is deemed to be in the interest of the public. 1 NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly that the following described tract of land it situated in the Kodiak Recording Precinct, Third Judicial _ I t State of Alaska, to -wit: A tract of land situate in U. S. Survey No. 3469 on Kodiak Island, Third Judicial District, State of Alaska, said tract being a portion of Kadiak Alaska Subdivision, and being more particularly described as follows, to -wit: Beginning at Corner 9 of U. S. Survey No. 3469, said corner also being the Southeast Corner of U. S. Survey No. 3218 and Corner 2 of U. S. Survey No. 3512; thence S 11 ° 51'32" E, 531.35 feet alcnd the East boundary of said U. S. Survey No. 3469 to the Southeast Corner of Tract "D" of said Kad. Alaska Subdivision; thence S 1 1 ° 47'23" E, 146.2D feet along the East boundary of said U. S. Survey No. 3469 and the East boundary of Tract "F" of Kadiak thence from a tangent b that s bears ts 2 0 ° 52' 1 04" W, along a curve to the right (radius equals 918.51 feet) through an angle of 54 ° 31'51 ", an arc distanc of 874.17 feet to a point on the South boundary of said U. S. Survey No. 3469; thence S 7 5 ° 23'55" n along said South boundary a distance of 1649.44 feet, more or less, to a point on the East right of way of Cutoff Road, State of Alaska Highway n n ; n FAS 389; thence N 10 °55'30" W along said right of way line a distance of 200.41 feet; thence thence 5 50 °30'33" E, a distance of 80.43 feet to a point of curve; thence from a tangent that bears N 58 °38'00" E, along a curve to the right (radius equals 1532.40 feet) through an angle of 16 °45'55 ", an arc distance of 448.39 feet; thence N 75 °23'55" E, a distance of 1147.35 feet to a point of curve; thence along a curve to the left (radius equals 718.51 feet) through an angle of 75 °16'55 ", an arc distance of 944.07 feet; thence N 0 °07'00" E, a distance of 337.39 feet to the point of beginning. EXCEPTING THEREFROM all those portions of Tracts "D" and "F" of said Kadiak Alaska Subdivision. This parcel containing 9.750 acres, more or less. Be and the same is hereby declared surplus to the Borough's needs, and that it would be in the interest of the public if this land should be transferred to the State of Alaska for use in its Highway Program of the Extension of Mill Bay Road project for less than the appraised value, to -wit: for the sum of ONE and No /100ths ($1.00) DOLLAR, and the Borough Chairman be and he is hereby authorized to convey the same to the State of Alaska Department of Highways and execute a Deed pursuant to this Resolution.
