1972-37 Declaring Certain Real Property Surplus To The Borough's Needs And Authorizing It's Sale.KODIAK ISLAND BOROUGH RESOLUTION NUMBER 72 -37 -R A THE ISLAND BOROUGH RESOLUTION PROPERTY ASSEMBLY THE SURPLUS BOROUG NEEDS AND AUTHORIZING ITS SALE i I , WHEREAS the Kodiak Island Borough 4 is the owner of I Tract "A ", Lot One (1), U. S. Survey No. 3465, and has received a request from DUANE H. FREEMAN, who is the owner of Lot Twelve A (12A), Block Three (3), Island Lake Subdivision, which adjoins II Lot One (1), Tract "A ", U. S. Survey No. 3465, and on which is situated a two - bedroom I panabode, and said person has petitioned I 1 the Kodiak Island Borough to purchase twenty (20) feet of Lot One (1), Tract "A ", U. S. Survey No. 3465, in order to clear up 4 an encroachment of his present building on said property, and in order to build two 2 ( ) more bedrooms onto his present home, and WHEREAS, the Petitioner desires to acquire from the Borough that portion of Lot One (1), Tract "A ", U. S. Survey It No. 3465 described as follows: Beginning at Corner 4, Tract "A ", U. S. Survey No. 3465; thence S 18 ° 13' W, 20.00 feet along it the Easterly boundary of said Tract; thence N 71 °23' W, 79.11 feet; thence in a Northwesterly direction 21.50 feet to a point on the Northerly boundary of Tract "A ", U. S. Survey No. 3465; thence S 71 ° 23' E, 87.00 feet along said boundary to the point of beginning, containing 1,661 square feet, more or less, and The Borough has had the same appraised, the same being valued at SIX HUNDRED SIXTY -FOUR AND 40 100ths DOLLARS 664.40 and this sum having been offered as a reasonable purchase price of the above - described portion of Lot One (1), Tract "A ", U. S. Survey No. 3465, and The Kodiak Island Borough having entered into a five -year lease with the Kodiak Lodge No. 1772 of the BPOE for all of Tract "A ", Lot One (1), U. S. Survey No. 3465, for a Page One, RESOLUTION NO. 72-37-R 1 1 •1 five -year period which expires on April 14, 1973, for use as "service recreational ", which said property is now zoned, but the above - described portion not being used for said purposes, and being surplus to the Borough's needs and being a Tract of land from which the Borough is not deriving any revenue. NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly that the following- described parcel of land situated in the Kodiak Recording Precinct, Third Judicial District,', State of Alaska, to -wit: Part of Lot One (1), Tract "A ", U. S. Survey No. 3465, described as beginning at Corner 4, Tract "A ", U. S. Survey No. 3465; thence S 18 ° 13' W, 20.00 feet along the Easterly Boundary of said Tract; thence N 71 °23' W, 79.11 feet; thence in a Northwesterly direction 21.50 feet to a point on the Northerly boundary of Tract "A ", U. S. Survey No. 3465; thence S 71!23' E, 87.00 feet along said boundary to the point of beginning, containing 1,661 square feet, more or less Be and the same is hereby declared surplus to the Borough's needs and not needed for or devoted to any public use, the Kodiak Lodge BPOE having signed a Relinquishment of said portion, and letter of non - objection dated August 3, 1972, the Borough Chairman is hereby authorized to sell the same to DUANE H. FREEMAN for the appraised cost, plus the cost of appraisal, and to execute a Deed pursuant to this Resolution, provided said portion is first rezoned and replatted.
