RESOLUTION NUMBER 71 -39 -R
A RESULUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
PROVIDING THAT A SPECIAL ELECTION BE HELD ON TUESDAY, THE 15TH
DAY OF FEBRUARY, 1972, FOR THE PURPOSE OF SUBMITTING TO THE DULY
QUALIFIED ELECTORS OF THE BOROUGH THE FOLLOWING PROPOSITIONS:
PROPOSITION NO. 1:
"Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding THREE MILLION
FIVE HUNDRED THOUSAND and No /100ths ($3,500,000.00) DOLLARS for
the purpose of constructing basic educational high school
facilities at Kodiak, together with appurtenances, auxiliary
space and site development necessary for said structure; and
. pledge the full faith and credit of the Kodiak Island Borough
I to the payment of any indebtedness so incurred and issue General 1
Obligation Bonds with interest at a rate not to exceed eight
t percent (8%) per annum, payable semi - annually, all as is
authorized by the Statutes of the State of Alaska and provided
by Resolution No. 71 -39 -R of the Kodiak Island Borough passed
and approved the 2nd day of December, 1971."
PROPOSITION NO. 2:
"Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding FIVE HUNDRED
THOUSAND and No /100ths ($500,000.00) DOLLARS for the purpose
of constructing a swimming pool as part of the Borough educational
complex at Kodiak, together with appurtenances, auxiliary
space and site development necessary for such swimming pool, and
pledge the full faith and credit of the Kodiak Island Borough
for the payment of any indebtedness so incurred and issue
General Obligation Bonds with interest at a rate not
to exceed eight percent (8%) per annum, payable semi - annually,
all as is authorized by the Statutes of the State of Alaska and
provided for by Resolution No. 71 -39 -R of the Kodiak Island
Borough passed and approved the 2nd day of December, 1971."
WHEREAS, the Kodiak Island Borough, State of Alaska,
is duly authorized to issue General Obligation Bonds payable
semi - annually by virtue of Section 07.15.030 and Section 07.30.010
of Alaska Statutes, and
WHEREAS, the Constitution of the State of Alaska
provides that no debt shall be contracted by any political
subdivision of the State, unless authorized for capital
improvements by its governing body and ratified by majority vote
of those qualified to vote and voting on the question, and the
Statutes of the State of Alaska provide for the qualification of
voters voting on the question of incurring bonded indebtedness;

NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly
of the Kodiak Island Borough, State of Alaska:
Section 1: That a Special Election be and the same
is hereby called to be held on Tuesday, the 15th day of February,
1972, between the hours of 8:00 o'clock a.m. and 8:00 o'clock p.m.
Standard Time of that day, there to be submitted to the duly
qualified electors of the Kodiak Island Borough, the following
Propositions:
PROPOSITION NO. 1:
"Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding THREE MILLION
FIVE HUNDRED THOUSAND and No /100ths ($ DOLLARS for
the purpose of constructing basic educational high school
facilities at Kodiak, together with appurtenances, auxiliary
space and site development necessary for said structure; and
pledge the full faith and credit of the Kodiak Island Borough
to the payment of any indebtedness so incurred and issue General
Obligation Bonds with interest at a rate not to exceed eight
percent (8%) per annum, payable semi - annually, all as is
authorized by the Statutes of the State of Alaska and provided
by Resolution No. 71 -39 -R of the Kodiak Island Borough passed
and approved the 2nd day of December, 1971."
PROPOSITION NO. 2:
"Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding FIVE HUNDRED
THOUSAND and No /100ths ($500,000.00) DOLLARS for the purpose
of constructing a swimming pool as part of the Borough educational
complex at Kodiak, together with appurtenances, auxiliary
space and site development necessary for such swimming pool, and
pledge the full faith and credit of the Kodiak Island Borough
for the payment of any indebtedness so incurred and issue
General Obligation Bonds with an interest at a rate not
to exceed eight percent (8%) per annum, payable semi - annually,
all as authorized by the Statutes of the State of Alaska and
provided for by Resolution No. 71 -39 -R of the Kodiak Island
Borough passed and approved the 2nd day of December, 1971."
Section 2: The manner of conducting and holding said
election and detail thereof shall be in accordance with the
requirements of the Laws of the State of Alaska and the Kodiak
Island Borough Code of Ordinances and Resolutions, pertaining
to bond elections where applicable or procedurally adaptable
for the purpose of approving or rejecting the authorization of
indebtedness and the proposed bond issues, except as hereinafter
specifically provided. Each ballot shall set forth the above

Propositions as set forth in Section 1 hereof, followed by the
following words:

Together with special instructions as to the manner
in which the ballots shall be marked.
Section 3: All duly qualified voters of the Kodiak
I Island Borough according to the Laws of the State of Alaska and
the Code of Ordinances and Resolutions of the Borough shall be
eligible to vote at said election.
Section 4: The polls of said election shall be open
durinc the time prescribed in Section 1 of this Resolution and
the polling places for said election shall be as follows:

All boundaries of all Precincts are as defined in
the Alaska Administrative Code 6AAC59 Section 336 through 345 and
in the Ordinances and Resolutions of the Kodiak Island Borough
and the Emergency Regulations of the Lieutenant Governor.
Section 5: The Clerk of the Kodiak Island Borough
shall issue and cause to be published and posted a public notice
of this election in the manner following:
(A) A copy of the notice prescribed by this Resolution
shall be published in the Kodiak Mirror, a newspaper of general
circulation, published in the Kodiak Island Borough, for three (3)
consecutive weekly publications.
(B) Copies of the notice shall be posted in each
polling place designated in Section 4 of this Resolution and
in addition thereto, copies of the notice shall be posted on the
bulletin board of the U. S. Post Office at Kodiak, and at the
City Hall at Kodiak, and at the front door of the Main School at
Kodiak, and all such notices shall be posted more than thirty
(30) days prior to the date of said election and the first
publication of said notice shall be more than thirty (30) days
prior to the date of said election.
Section 6: The Notice of Special Election shall
be signed by the Clerk of the Kodiak Island Borough and shall be
substantially in the following form:
NOTICE OF SPECIAL ELECTION
At a Special Election to be held in the Kodiak
Island Borough on Tuesday, the 15th day of February, 1972, the
following Propositions will be submitted to the qualified voters
of the Kodiak Island Borough:
PROPOSITION NO. 1:
"Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding THREE MILLION
FIVE HUNDRED THOUSAND and No /100ths ($3,500,000.00) DOLLARS for

The boundaries of all precincts are as defined in

The total bonded indebtedness, including authorized

FOUR MILLION SIX HUNDRED THIRTY -THREE THOUSAND TWENTY -SEVEN and
No /100ths ($4,633,027.00) DOLLARS.
The cost of the debt service on the current
indebtedness is ONE HUNDRED TWENTY -SIX THOUSAND FOUR HUNDRED
FIVE and No /100ths ($126,405.00) DOLLARS.
The total assessed valuation within the Kodiak Island
Borough is SIXTY -NINE MILLION ONE HUNDRED TWENTY -SIX THOUSAND
ONE HUNDRED TWENTY -THREE and No /100ths ($69,126,123.00) DOLLARS.
If a majority or more of the qualified voters voting
at said election vote in favor of Proposition No. 1 herein as
above set forth, the Borough Assembly of the Kodiak Island Borough,
pursuant to the provisions of Section 07.15.030 and Section
07.30.010, will issue General Obligation Bonds for the purposes
set forth in Proposition No. 1 as approved by the voters and said
General Obligation Bonds will be in the amount of Proposition
No. 1 approved by the voters and in such series and denominations
as may be required, secured by a pledge of the full faith and
credit of the Kodiak Island Borough, and the Borough Assembly will
take such further action as may be necessary in the premises.
If a majority or more of the qualified voters voting
at said election vote in favor of Proposition No. 2 herein as
above set forth, the Borough Assembly of the Kodiak Island Borough,
pursuant to the provisions of Section 07.15.030 and Section
07.30.010, will issue General Obligation Bonds for the purposes
set forth in Proposition No. 2 as approved by the voters and said
General Obligation Bonds will be in the amount of Proposition
No. 2 approved by the voters and in such series and denominations
as may be required, secured by a pledge of the full faith and
credit of the Kodiak Island Borough, and the Borough Assembly will;
take such further action as may be necessary in the premises.
Any qualified voter within the Borough who expects

to be absent from his Election Precinct on the day of the Election,
or who will be unable to vote in said Borough Election Precinct,
by reason of physical disability on the day which the Special
Election is held, or if that person believes he or she will be
unable to be present at the polls because of physical
inaccessibility of the polling place, causing undue travel
expense, hardship or hazard, such person may cast a ballot in said
Borough Election upon complying with the provisions for casting an
absentee ballot.
Such person shall make application for an absentee
ballot not more than twenty (20) nor less than five (5) days
before the date of Election if application is made by mail, and
not more than twenty (20) days nor less than one (1) day if the
application is made in person. Any such person may file either
in person or by mail, his written application to the Borough
Clerk for an absentee voter's ballot. The application shall be
signed by the applicant, show his place of residence, and shall
make clear to the Clerk of the Borough, the applicant's right
to a ballot. The absentee voter must appear before any Notary
Public or officer in the District, City, Borough, Territory, or
I other Federal District in any State, Territory or District within
the United States or District of Columbia, or before two (2)
attesting witnesses, both of whom shall be qualified voters of
I the Borough.

Section 8: Absentee Voting: Persons Entitled to
Vote: Any qualified voter within the Borough who expects to be
absent from his Election Precinct on the day of the Election, or ■

who will be unable to vote in said Borough Election Precinct,
by reason of physical disability on the day which the Special
Election is held, or if such person believes he or she will be
unable to be present at the polls because of physical
inaccessibility of the polling place, causing undue travel
expense, hardship or hazard, such person may cast a ballot in
said Borough Election upon complying with these provisions for
casting an absentee ballot.
Application for Ballots: Time requisites; not
more than twenty (20) nor less than five (5) days for filing by .
mail, and not more than twenty (20) days nor less than one (1)
day for filing in person, prior to the Borough Election date,
any voter, being properly qualified, who expects to be absent
from his Election Precinct, or unable to vote therein on the day
of Election, may file either in person or by mail, his written
application to the Borough Clerk for an absentee voter's ballot.
The application shall be signed by the applicant, show his or
her place of residence, and shall make clear to the Clerk of
the Borough the applicant's right to a ballot. The absentee
voter must appear before any Notary Public or officer in the
District, City, County, Borough, Territory or other Federal
District, or in any State, Territory or District within the
United States or District of Columbia, or before two (2)
attesting witnesses, both of whom shall be qualified voters of
the Borough.
Section 9: The judges and clerks of said Election
to be hereafter appointed by resolution of the Borough Assembly,
shall canvass the votes cast at said Election on the Propositions
above stated, and shall prepare and file their returns of said
Election with the Borough Assembly, stating in words and figures
the number of votes cast for and against the Propositions voted
upon, and if the number of votes cast for Proposition No. 1 be

not less than a majority of the votes cast on that Proposition,
certify that the Proposition carried and if otherwise, then that
the Proposition failed, and if the votes cast in the affirmative
on Proposition No. 2 be not less than a majority of the votes
cast on that Proposition, certify that that Proposition carried,
and if otherwise, then that that Proposition _
Section 10: If Proposition No. 1 is certified by
the Election officials as having received the required majority
of qualitifed votes for approval, and having been thereby
regularly carried, then said Borough Assembly of the Kodiak
Island Borough, upon canvass of the returns made, in their
discretion may authorize the issuance of General Obligation
Bonds in the amount approved by the voters at said Election,
plus interest, payable semi - annually and maturing within
twenty -five (25) years or less, the proceeds of which shall be
used by the Borough Assembly of the Kodiak Island Borough for
the purposes described in Section 1 as part of Proposition No. 1
above, and which General Obligation Bonds shall be issued in
such series and denominations as the Borough Assembly may deem
I necessary from time to time.
If Proposition No. 2 is certified by the Election
officials as having received the required majority of qualified
I votes for approval, and having been thereby regularly carried,
then said Borough Assembly of the Kodiak Island Borough, upon
canvass of the returns made, in their discretion, may authorize
the issuance of General Obligation Bonds in the amount approved
by the voters at said Election, plus interest, payable
semi - annually and maturing within twenty -five (25) years or
less, the proceeds of which shall be used by the Borough Assembly
of the Kodiak Island Borough for the purposes described in
Section 1 as part of Proposition No. 2 abve and such General
Obligation Bonds shall be issued in such series and denominations.
