1971-21 Approving The Final Plat Of The Yanovsky Street Vacation Replat, Block Seven, Leite Addition.1 n 1 1 1 n A A A KODIAK ISLAND BOROUGH RESOLUTION NUMBER 71 -21 -R A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK ISLAND BOROUGH APPROVING THE FINAL PLAT OF THE YANOVSKY STREET VACATION REPLAT, BLOCK SEVEN (7), LEITE ADDITION WHEREAS, JOHN R. SPONSEL and DOROTHY SPONSEL, EUGENIA STRIGGA, H. BRECKBERG, WILLIAM DAMERY and REGGIE DAMERY petitioned the Kodiak Island Borough Planning and Zoning Commission and the Kodiak Island Borough Assembly for the vacation of a portion of Yanovsky Street in Block Seven (7) of the Leite Addition, in a plat entitled "Yanovsky Street Vacation and Replat, Block 7 Leite Addition" and which portion of Yanovsky Street to be vacated lies to the East of Lot Twenty -Five (25), Block Seven (7), Leite Addition, between Lots Three (3) to Nine (9) and Lots Eighteen (18) to Twenty -Four (24) and to the West of Lots Ten (10) and Seventeen (17) of said Block Seven (7), and WHEREAS, the basis for said Petition was that there was not enough area existing on the East side of the alley South of Lots Nine (9) and Eighteen (18) to build on as during the tidal wave action and since, approximately 25 feet of the lot area of those Lots has eroded away on the beach side, and further, that a 40 -foot street on the West side of Lots One (1) to Nine (9) would give ingress to all property concerned, and WHEREAS, all persons interested were notified that a public hearing would be held on said Petition on II the 17th day of January, 1966 but the final plat had not been submitted for approval and the same now having been Page One, RESOLUTION NO. 71 -21 -R as shown and set forth submitted for approval and all the stipulations having been met and the Borough Assembly finding that a public hearing was duly noticed and held and a copy of the Affidavit of Publication having been filed herein, at which hearing the Planning and Zoning Commission recommended that the above - described portion of Yanovsky Street be vacated and the Kodiak Island Borough Assembly being fully advised in the premises, NOW, THEREFORE, BE IT RESOLVED that that portion of Yanovsky Street described as follows: To the East of Lot Twenty -Five (25), Block Seven (7), Leite Addition, between Lots Three (3) to Nine (9) and Lots Eighteen (18) to Twenty -Four (24) and to the West of Lots Ten (10) and Seventeen (17) of said Block Seven (7), Be and the same is hereby vacated in accordance with Sections 40.15.140 and 40.15.180, Alaska Statutes, and in accordance with the Yanovsky Street Vacation and Replat, Block 7 Leite Addition filed herein, prepared by Roy A. Ecklund, Registered Land Surveyor, dated July 25, 1971. AND BE IT FURTHER RESOLVED that the Kodiak Island Borough accept all easements dedicated for public use as set forth in said Vacation and Replat. PASSED AND APPROVED this 5th day of August, 1971.
