A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE
KODIAK ISLAND BOROUGH VACATING A PORTION OF ERSKINE AVENUE
IN U. S. SURVEY NO. 562
WHEREAS, LOUIS P. IANI and FRED C. BRECHAN have
petitioned the Kodiak Island Borough Planning and Zoning
Commission and the Kodiak Island Borough Assembly for the
vacation of a portion of Erskine Avenue in U. S. Survey
No. 562, described as:
Commencing at Corner 1, U. S. Survey No. 562;
thence N 89 ° 56' W, 256.60 feet along the
Southerly boundary of said survey, to the
Easterly right of way of Erskine Avenue, the
true point of beginning. Thence North 50.01
feet along said right of way to the Southerly
right of way of Rezanof Drive; thence the
following course along said Drive: North
89 °56' W, 25.00 feet; North 20.00 feet; North
89 °56' W, 25.00 feet; thence South 70.01 feet
to the intersection of the Southerly boundary
of U. S. Survey No. 562; thence South 89 °56' E
50.00 feet along said boundary to the true
point of beginning, containing 3,000 square
feet more or less.
WHEREAS, the basis for said Petition is that
due to the high elevation of Rezanof Drive, it is impractical
to connect the lower portion of Erskine Avenue to Rezanof
Drive and that none of the lots below Rezanof Drive are
accessible from Rezanof Drive due to that high elevation,
therefore ingress and egress must be made from lower Erskine
Avenue. No other property is affected by the vacation and
the Petitioners intend to build multi - residential units on
Lots Forty (40) through Forty -five (45), Block One (1),
Erskine Subdivision, including use of the vacated portion of
Erskine Avenue, and
WHEREAS, all persons interested were notified
that a public hearing would be held on said Petition on

Wednesday, May 26, 1971, at 7:30 o'clock in the District
Courtroom, State Office Building, Kodiak, Alaska, before the
Island Borough Planning and Zoning Commission, which
public hearing was duly noticed and held, a copy of the
Affidavit of Publication having been filed herein and at
which hearing the Planning and Zoning Commission recommended
that the above described portion of Erskine Avenue be vacated,
and the Kodiak Island Borough Assembly being fully advised
in the premises;
NOW, THEREFORE, BE IT RESOLVED that that portion
of Erskine Avenue described as follows:
Commencing at Corner 1, U. S. Survey No. 562;
thence N 89 ° 56' W, 256.60 feet along the
Southerly boundary of said survey, to the
Easterly right of way of Erskine Avenue, the
true point of beginning. Thence North 50.01
feet along said right of way to the Southerly
right of way of Rezanof Drive; thence the
following course along said Drive: North
89 °56' W, 25.00 feet; North 20.00 feet; North
89 °56' W, 25.00 feet; thence South 70.01 feet
to the intersection of the Southerly boundary
of U. S. Survey No. 562; thence South 89 °56' E,
50.00 feet along said boundary to the true
point of beginning, containing 3,000 square
feet more or less
Be and the same is hereby vacated in accordance
with the Sections of 40.15.140 through 40.15.180, Alaska
I 'd Statutes and in accordance with the plat filed herein,
prepared by Roy A. Ecklund, registered land surveyor, dated
'. June 18, 1971.
AND BE IT FURTHER RESOLVED that the Kodiak Island
Borough accept all easements for utilities and power
transmission lines as set forth in said plat.
