1971-05 Providing That A Special Election Be Held On Thursday, May 6, 1971, For The Purpose Of Submitting To The Duly Qualified Electors Of The Borough A Proposition Regarding Construction Of An Elementary School In Ouzinkie, Alaska.KODIAK ISLAND BOROUGH RESOLUTION NUMBER 71 -5 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY PROVIDING THAT A SPECIAL ELECTION BE HELD ON THURSDAY, MAY 6, 1971, FOR THE PURPOSE OF SUBMITTING TO THE DULY QUALIFIED ELECTORS OF THE BOROUGH THE FOLLOWING PROPOSITION: "Shall the Kodiak Island Borough be authorized to expend TWO HUNDRED FORTY THOUSAND AND NO /100THS ($240,000.00) DOLLARS of Public Law 815 funds which it is entitled to receive from the United States Government; said expenditure to be for construction of an elementary school building and multi - purpose unit at Ouzinkie, Alaska, together with appurtenances and auxiliary space and site development necessary for said structures." WHEREAS, the Kodiak Island Borough, State of Alaska, is duly authorized to call special elections pursuant to Section 07.30.030 of Alaska Statutes, and Section 4.1 of the Kodiak Island Borough Code of Ordinances and Resolutions by giving prior notice by posting and publication at least thirty (30) days prior thereto, and WHEREAS, the present school facilities at Ouzinkie, Alaska are no longer adequate and are in such a state of repair that they should be replaced as soon as possible, N)W, THEREFORE, BE IT RESOLVED by the Borough I Assembly of the Kodiak Island Borough, State of Alaska: Section 1: That a Special Election be and the same is hereby called to be held on Thursday, the _6th day of May, 1971, between the hours of 8:00 o'clock a.m. and 8 :00 o'clock p.m., Standard Time of that day, there to be submitted to the qualified voters of the Kodiak Island Borough, the following Proposition: "Shall the Kodiak Island Borough be authorized to expend TWO HUNDRED FORTY THOUSAND AND NO /100THS ($240,000.00) DOLLARS of Public Law 815 funds which it is entitled to receive ' from the United States Government; said expenditure to be for construction of an elementary school building and multi- ' purpose unit at Ouzinkie, Alaska, together with appurtenances and auxiliary space and site development necessary for said structures." Section 2: The manner of conducting and holding said election and detail thereof shall be in accordance with the Page One, RESOLUTION NO. 71 -5 -R requirements of the State Laws and the Kodiak Island Borough Code of Ordinances and Resolutions. Each ballot shall set forth the above Proposition as set forth in Section One hereof and shall be followed by the following words: "Expenditure P.L. 815 funds - Yes / Expenditure P.L. 815 funds - No /7 " Together with special instructions as the manner in which the ballot shall be marked. Section 3: All duly qualified voters of the Kodiak Island Borough according to the laws of the State of Alaska and the Code of Ordinances and Resolutions of the Borough shall be eligible to vote at said election. Section 4: The polls of said election shall be open during the time prescribed in Section One of this Resolution and the polling places for said election shall be as follows: Precinct Name Precinct Number Polling Place Alitak 4 Akhiok School, Akhiok, Alaska Karluk 5 Karluk School, Karluk, Alaska Kodiak 1 City Fire Station, Benson Avenue, Kodiak, Alaska Kodiak 2 Harbormaster's Building, Marine Way, Kodiak, Alaska Kodiak 3 National Guard Armory, Sixth Street, Kodiak, Alaska Larsen Bay 6 Larsen Bay Community Hall, Larsen Bay, Alaska Mission Road 7 East Elementary School Building, Kodiak, Alaska Old Harbor 8 Larry's Theater, Old Harbor, Alaska Ouzinkie 9 Ouzinkie School, Ouzinkie, Alaska Port Lions 10 Port Lions Community Center, Port Lions, Alaska Uganik Bay 11 Uganik Bay Trading Company, Uganik Bay, Alaska The boundaries of all Precincts are as defined in Page Two, RESOLUTION NO. 71 -5.R the Alaska Administrative Code 6AAC59 Section 336 through 345 and in the Ordinances and Resolutions of the Kodiak Island Borough and the Emergency Regulations of the Secretary of State. Section 5: The Clerk of the Kodiak Island Borough shall issue and cause to be published and posted a public notice of this election in the manner following: (A) A copy of the notice prescribed by this Resolu- tion shall be published in the Kodiak Mirror, a newspaper of general circulation, published in the Kodiak Island Borough, for three (3) consecutive weekly publications. (B) Copies of the notice shall be posted in each polling place designated in Section Four of this Resolution and in addition thereto, copies of the notice shall be posted on the bulletin board of the U.S. Post Office at Kodiak, and at the City Hall at Kodiak, and at the front door of the Main School at Kodiak, and all such notices shall be posted more than thirty (30) days prior to the date of said election and the first publication of said notice shall be more than thirty (30) days prior to the date of said election. Section 6: The notice of Special Election shall be signed by the Clerk of the Kodiak Island Borough and shall be substantially in the following form: NOTICE OF SPECIAL ELECTION At a special election to be held in the Kodiak Island Borough on Thur sda }�, thelth day of May, 1971, the following Proposition will be submitted to the qualified voters of the 'Kodiak Island Borough: "Shall the be authorize to expend TWO HUNDRED FORTY Kodiak ($240,000.00) ' � DOLLARS of Public Law 815 funds which it is entitled to receive from the United States Government; said expenditure to be for construction of an elementary school building and multi - purpose unit at Ouzinkie, Alaska, together with appurtenances and auxiliary space and site development necessary for said structures." If a majority or more of the qualified voters voting at said election vote in favor of the Proposition herein as set .forth, the Borough Assembly of the Kodiak Island Borough will authorize the construction of the Ouzinkie Elementary School Building and multi - purpose unit. KODIAK ISLAND BOROUGH By: RUSSELL WALKER, CLERK Section 8: Absentee Voting: Persons entitled to vote: Any qualified voter within the Borough who expects to be absent from his election precinct on the day of the election, or who will be unable to vote in said Borough election precinct, by 1 reason of physical disability on the day which any special or general election is held, or if he believes he will be unable to Page Four, RESOLUTION NO. 71 -5-R be present at the polls because of physical inaccessibility of the polling place causing undue travel expense, hardship or hazard, may cast a ballot in said Borough election upon complying with these provisions for casting an absentee ballot. Application for Ballots: Time requisite; not more than twenty (20) nor less than five (5) days for filing by mail, and not more than twenty (20) days nor less than one (1) day where filing in person, prior to the Borough election, any voter, being properly qualified, who expects to be absent from his of election precinct, or unable to vote therein on the day election, may file either in person or by mail, his written application to the Borough Clerk for an absentee voter's ballot. The application shall be signed by the applicant, show his place of residence, and shall make clear to the Clerk of the Borough of the applicant's right to a ballot. The absentee voter must appear before any Notary Public or officer in the District, City, County, Borough, Territory or other Federal District, or in any State, Territory or District within the United States or District of Columbia, or before two (2) attesting witnesses, both of whom shall be qualified voters of the Borough. Section 9: The judges and clerks of said election to be hereafter appointed by Resolution of the Borough Assembly shall canvass the votes cast at said election on the Proposition above stated and shall prepare and file their returns of said election with the Borough Assembly, stating in words and figures ,the number of votes cast for and against the proposal voted upon, be not less than a majority of the votes cast on that Proposition, certify that the Proposition carried and if otherwise, then that the Proposition failed. Section 10: If the Proposition is certified by the 'election officials as having received the required majority of .., qualified votes for approval, and having been thereby regularly Page Five, RESOLUTION NO. 71 -5 -R carried, then said Borough Assembly of the Kodiak Island Borough upon canvass of the retutns made, in their discretion, may authorize the execution of a contract for the construction of the elementary school building and multi - purpose unit at Ouzinkie in the amount authorized by the voters at said election.
